Status

Overruled in part
A reviewed court has overruled part of this case’s holding. United States v. Williams was overruled in part on crack and powder cocaine sentencing. The Supreme Court held in Kimbrough v. United States that a sentencing judge may consider the Guidelines' crack/powder disparity, contrary to Williams's prohibition.
More on how this was screened

The Eleventh Circuit later described Kimbrough as overruling that part of Williams. All 68 flagged citations have been read; the one confirmed treatment is listed below. The Eleventh Circuit's later references to Kimbrough describe the same change, so they are not separate entries. The opinion at 435 F.3d 1350 is a different United States v. Williams.

Every treatment on this page is written from the citing opinion itself, with a verbatim quote, never copied from a commercial citator. A citation flagged by our screen but not shown here was read and found not to weaken this case.

68 later cases cite United States v. Williams; 68 of those citations sat close to treatment language and were flagged for reading, and all of them have been read. Citations that did not sit near treatment language were not flagged and were not read one by one, so a court that weakened this case without using any of that language would not appear here.
