5. LEGAL BASIS FOR THIS DEMAND
5.1 North Dakota Wage Collection Law (N.D.C.C. Chapter 34-14)
The North Dakota Century Code, Title 34, Chapter 14, governs the collection of wages owed to employees by employers in North Dakota. This chapter defines "employer" broadly to include every person, firm, partnership, association, corporation, receiver, or other officer of a court, and any agent or officer of any of the above-mentioned classes, employing any person in the state.
5.2 Payment of Wages (N.D.C.C. Section 34-14-02)
Under Section 34-14-02, every employer in North Dakota shall pay all wages due to its employees at least once each calendar month, on regular paydays designated in advance by the employer. Wages must be paid in lawful money of the United States or by check, draft, or money order convertible into cash on demand at full face value.
The Employer has failed to comply with this requirement by failing to pay wages owed for the period(s) described above.
5.3 Final Pay — Wages of Separated Employees (N.D.C.C. Section 34-14-03)
When any employee separates from employment (whether terminated, laid off, or voluntarily resigned), the employer must pay all wages due by the next regular payday. This requirement applies regardless of whether the separation was voluntary or involuntary.
Key provisions:
- The employer cannot condition final payment on the return of employer property or execution of a release.
- All earned wages, including earned commissions and agreed-upon bonuses, must be included in the final paycheck.
☐ The Employee separated from employment on [__/__/____].
☐ The next regular payday following separation was [__/__/____].
☐ The Employer failed to pay final wages by the next regular payday.
5.4 Deductions from Wages (N.D.C.C. Section 34-14-04)
Employers may not withhold or deduct any portion of an employee's wages unless:
- The deduction is required by state or federal law (e.g., taxes, garnishments);
- The employee has provided written authorization for the specific deduction; or
- The deduction is for the employee's benefit (e.g., insurance premiums, retirement contributions) and is authorized in writing.
Employers may not deduct for breakage, shortages, or other business losses without proper written authorization.
☐ The Employer made unauthorized deductions from the Employee's wages in violation of Section 34-14-04.
5.5 Minimum Wage (N.D.C.C. Section 34-06-22)
North Dakota's minimum wage is set at $7.25 per hour, which matches the federal minimum wage rate. The minimum wage for tipped employees is $4.86 per hour (calculated as 33% below the standard rate), provided that the employee's tips bring total compensation to at least $7.25/hr.
North Dakota does not have an automatic cost-of-living adjustment for minimum wage; any change requires legislative action.
☐ The Employer paid the Employee below the applicable minimum wage rate during the period(s) in question.
5.6 Overtime Provisions
North Dakota follows the federal Fair Labor Standards Act (FLSA) for overtime requirements and does not have additional state-specific overtime provisions beyond federal law. Under the FLSA, covered employers must pay non-exempt employees overtime compensation at a rate of not less than one and one-half (1.5) times the regular rate of pay for all hours worked in excess of forty (40) hours in a workweek. 29 U.S.C. Section 207(a)(1).
Exemptions under North Dakota law include:
- Agricultural employees (exempt from both minimum wage and overtime under N.D.C.C. 34-06-01);
- Outside salespersons whose work away from the employer's premises is primarily sales-related and work unrelated to outside sales does not exceed 20% of weekly hours.
☐ The Employer failed to pay proper overtime compensation as required.
5.7 Penalties and Interest on Unpaid Wages (N.D.C.C. Sections 34-14-07 and 34-14-09.1)
North Dakota law provides penalties for employers who fail to pay wages when due:
Section 34-14-07 (Penalties): An employer who violates the wage payment provisions of Chapter 34-14 is subject to criminal penalties, including fines and potential imprisonment for willful violations.
Section 34-14-09.1 (Interest on Unpaid Wages; Amount of Recovery): An employee who prevails in a wage claim action may recover:
- Payment of the wages owed plus interest on unpaid wages;
- Enhanced damages — employees may be entitled to double the amount of unpaid wages in cases of willful non-payment;
- Court costs and reasonable attorney's fees.
5.8 Enforcement by Commissioner (N.D.C.C. Section 34-14-05)
The North Dakota Labor Commissioner has authority to:
- Receive and investigate wage claims;
- Hold hearings to determine the validity and amount of claims;
- Issue orders requiring employers to pay wages found to be due;
- With the assistance of the State's Attorney, initiate court proceedings on behalf of employees to collect unpaid wages.
The Commissioner's enforcement powers make the administrative route a significant remedy available to employees who have been denied wages.
6. DEMAND FOR PAYMENT
Based on the foregoing facts and applicable law, the undersigned hereby demands payment of $[________________________________] representing the total unpaid wages and compensation owed.
6.1 Payment Terms
Payment must be received on or before [__/__/____] (not less than fifteen (15) calendar days from the date of this letter).
Payment shall be made in the form of:
☐ Certified check or cashier's check
☐ Company check
☐ Wire transfer to the following account: [________________________________]
☐ Direct deposit to the account on file
☐ Money order
☐ Other: [________________________________]
Payment shall be made payable to: [________________________________]
Payment shall be delivered to: [________________________________]
6.2 Good Faith Resolution
The undersigned is willing to discuss a reasonable resolution of this matter in good faith. However, the Employer should be aware that continuing failure to pay wages will only increase the potential exposure through accruing interest and enhanced damages.
6.3 Disputed Amounts
If the Employer disputes any portion of the wages claimed, the Employer should pay the undisputed amount immediately and provide a written explanation detailing the basis for the dispute. Partial payment does not constitute a release of the Employee's claim to the remaining balance.
7. CONSEQUENCES OF NON-PAYMENT
If the Employer fails to pay the full amount of wages owed by the deadline stated above, the undersigned intends to pursue one or more of the following remedies:
7.1 Administrative Wage Claim — ND Department of Labor and Human Rights
The Employee may electronically file a wage claim with the North Dakota Department of Labor and Human Rights. The Department's wage claim process includes:
- Investigation — The Department will investigate the claim and contact the employer for a response.
- Mediation / Hearings — The Department may hold hearings to resolve the dispute.
- Court Action — If hearings are unsuccessful, the Department can initiate a court case on behalf of the employee, with the assistance of the State's Attorney.
- Order to Pay — The Department may issue an order requiring the employer to pay wages found to be due, plus interest and penalties.
7.2 Civil Action
The Employee may file a civil lawsuit in the appropriate North Dakota court to recover:
- All unpaid wages and compensation owed;
- Interest on unpaid wages from the date each amount became due;
- Double or triple damages (for repeat violations or willful non-payment);
- Court costs and reasonable attorney's fees;
- Such other relief as the court deems just and proper.
7.3 Federal Wage Claims
If applicable, the Employee may also file a complaint with the U.S. Department of Labor, Wage and Hour Division for FLSA violations, including unpaid minimum wage and overtime claims. Federal remedies may include back pay, liquidated damages equal to the back pay amount, and attorney's fees.
7.4 Referral to State's Attorney
Under N.D.C.C. Section 34-14-05, the Labor Commissioner may refer unpaid wage matters to the State's Attorney for enforcement. Willful refusal to pay wages may also constitute grounds for criminal prosecution.

About This Template
Employment documents govern the relationship between a company and its workers, from offer letters and employment agreements through handbooks, performance reviews, and separations. Done right, they set clear expectations, protect against wrongful termination and discrimination claims, and give both sides a record to rely on. Done poorly, they invite lawsuits, agency complaints, and costly disputes.
