VIRGINIA TEMPORARY CUSTODY AGREEMENT

Pendente Lite / Interim Custody Stipulation

Pursuant to Va. Code §§ 20-103 and 20-124.1 et seq.

VIRGINIA FRAMEWORK FOR TEMPORARY CUSTODY

Virginia law provides several mechanisms for temporary custody arrangements:

1. Pendente Lite Orders (Va. Code § 20-103): In suits for divorce, annulment, and separate maintenance, and in proceedings under Va. Code § 16.1-241, the court may make any order "proper to provide for the custody and maintenance of the minor children of the parties" pending the final resolution of the case. Pendente lite custody orders are made in accordance with the best-interest factors of Va. Code §§ 20-124.1 et seq. (Va. Code § 20-103).

2. J&DR Court Emergency Jurisdiction (Va. Code § 16.1-241): The Juvenile and Domestic Relations District Court has jurisdiction over custody and visitation petitions and may issue temporary orders, including in emergency situations where a child is in danger.

3. Preliminary Protective Orders (Va. Code § 16.1-253): In cases involving family abuse, the court may issue a preliminary protective order that includes temporary custody provisions, effective for fifteen (15) days or until a full hearing.

4. Military Deployment (Va. Code § 20-124.8): Virginia law provides for expedited hearings and temporary custody arrangements when a parent receives military deployment orders.

5. Delegation of Parental Authority (Va. Code § 20-166): A parent may delegate certain custodial powers to another adult via a properly executed power of attorney, which is effective for up to six (6) months and may address school enrollment and medical consent.

Important Note: A pendente lite order is fully enforceable but is temporary in nature. It does not establish a presumption for the final custody determination and does not constitute a final adjudication of the parties' rights. See Va. Code § 20-103.

Virginia Court Structure:

  • J&DR Court: May issue temporary custody orders under § 16.1-241.
  • Circuit Court: May issue pendente lite orders in connection with divorce under § 20-103.
  • Appeals: J&DR Court orders are appealed to Circuit Court for de novo review within 10 days.

2. TEMPORARY CUSTODY ARRANGEMENT

2.1 Type of Temporary Custody

Select one:

Option A: Temporary Sole Custody to One Parent
[________________________________] (Name) shall have temporary sole legal and sole physical custody of the Children during the temporary period. This Parent shall have authority to make all major decisions during the temporary period, consistent with Va. Code § 20-124.1 (sole custody definition).

Option B: Temporary Joint Custody Between Parents
Both Parents shall share temporary custody during the temporary period as follows:

  • Temporary Legal Custody: ☐ Joint ☐ Sole to [________________________________]
  • Temporary Physical Custody Schedule: [________________________________]
This arrangement is pending ☐ final divorce decree / ☐ permanent custody determination / ☐ other: [________________________________]

  • Decision-making authority during temporary period: See Section 2.4.

Virginia Note for Non-Parent Custody: Under Virginia law, there is a strong presumption in favor of a natural parent. Temporary custody to a non-parent typically requires either parental consent, a finding of unfitness, or a finding that the child's welfare would be adversely affected by remaining with the parent. See Bailes v. Sours, 231 Va. 96 (1986). A power of attorney under Va. Code § 20-166 may also authorize a non-parent caretaker.

The Children shall reside primarily with [________________________________] (Temporary Custodian) at:

City, State, ZIP: [________________________________]

This determination is based on the best-interest factors of Va. Code § 20-124.3 and ☐ the existence of a protective order / ☐ safety concerns as follows: [________________________________]

  • During deployment, the non-deploying Parent shall have primary physical custody.

About This Template

Family law covers the paperwork that shapes divorce, custody, child support, adoption, guardianship, and other family matters. These filings are emotional and high-stakes, and they also have to meet strict procedural rules for service, financial disclosure, and parenting plans. Clean, accurate paperwork keeps the focus on getting a workable outcome for the family instead of getting derailed by technical problems that delay hearings or force amended filings.

Important Notice
