A. Temporary custody arrangements in Delaware are governed by Del. Code tit. 13, Chapter 7, Subchapter II.

B. Under § 727, the Family Court may grant temporary joint or sole custody for a period not to exceed six months to give parents the opportunity to demonstrate their ability and willingness to cooperate with the custodial arrangement ordered. After review, the Court may continue or modify the temporary order on a permanent basis.

C. Interim orders are modifiable at any time under § 729(a) in accordance with the best interest factors of § 722, without the heightened standard that applies to contested permanent orders.

D. The Preliminary Injunction issued upon filing a Petition for Custody (Form #345) prohibits either Parent from permanently removing the child(ren) from Delaware during proceedings without the other Parent's permission or Court approval.

About This Template

Family law covers the paperwork that shapes divorce, custody, child support, adoption, guardianship, and other family matters. These filings are emotional and high-stakes, and they also have to meet strict procedural rules for service, financial disclosure, and parenting plans. Clean, accurate paperwork keeps the focus on getting a workable outcome for the family instead of getting derailed by technical problems that delay hearings or force amended filings.

Important Notice
