The New Jersey Department of Community Affairs' Truth in Renting guide explains that rent may not be increased during a lease term. To increase rent, the landlord must terminate the old lease and offer a new lease at the increased rent. Proper written notice must state that the tenant may remain by paying the increased rent, and the landlord must serve a valid notice to quit together with the rent-increase notice. An increase may not be unconscionable and must comply with applicable municipal rent-control law. N.J.S.A. 2A:18-61.1(f) addresses failure to pay a lawful rent increase after the required notice and does not excuse any procedural step.
