California Notice and Statewide-Cap Module
For a residential periodic tenancy, calculate the proposed increase together with every increase during the preceding 12 months against the lowest rental amount charged to this tenant in that period. Written notice is due at least 30 days before the effective date when that cumulative increase is 10% or less, and at least 90 days before the effective date when it is greater than 10%. A required income or family-composition recertification that causes an increase uses the 30-day rule in § 827(b)(3)(B). Deliver personally or by mail under § 827(b), allowing the extra time required by Code of Civil Procedure § 1013 for mail. A covered unit is also limited by Cal. Civ. Code § 1947.12 to 5% plus the applicable cost-of-living percentage or 10%, whichever is lower, calculated from the lowest gross rent in the prior 12 months (excluding accepted discounts, incentives, concessions, or credits), with no more than two increments for the same continuing tenant.

Landlord-tenant paperwork governs who can stay in a property, on what terms, and what happens when something goes wrong. Leases, notices to quit, security deposit demands, and habitability complaints all have state and often city-specific requirements for timing, content, and service. Getting the paperwork right is what makes an eviction actually succeed or a security deposit actually come back, because judges regularly dismiss cases over small procedural mistakes.
