Current New Jersey Division on Civil Rights guidance states that an emotional-support, therapy, or assistance animal in housing need not be specially trained. A reasonable accommodation may include an exception to a no-pets policy or a weight or size restriction. Other than payment for specific damage, the guidance states that an extra animal fee is unlawful.
A provider may impose reasonable conduct and sanitation conditions. A denial must rest on an individualized, fact-sensitive finding that the request is unreasonable, including an undue administrative or financial burden or fundamental alteration. HUD's narrower May 2026 federal enforcement policy does not amend the New Jersey Law Against Discrimination.
