STATE-SPECIFIC NOTES — DISTRICT OF COLUMBIA

  • DC follows equitable distribution principles under D.C. Code § 16-910.
  • DC permits postnuptial agreements under requirements similar to prenuptial agreements, governed by the D.C. Premarital Agreements Act (D.C. Code § 46-501 et seq.) by analogy.
  • Courts apply heightened scrutiny to postnuptial agreements because the parties are already married and owe fiduciary duties to each other.
  • Key grounds for challenging enforceability: (1) agreement was not signed voluntarily, (2) agreement was unconscionable at execution, or (3) full and fair financial disclosure was not provided.
  • An unequal division does not automatically invalidate the agreement, but if circumstances change, an unfair portion may not be enforced.
  • Both parties must disclose their net worth for the agreement to be valid.
  • Independent counsel for both parties is strongly recommended.
  • Child custody and support remain subject to court jurisdiction.
  • Federal employees: Special considerations may apply regarding federal pensions, TSP accounts, and FEHB benefits.

About This Template

Family law covers the paperwork that shapes divorce, custody, child support, adoption, guardianship, and other family matters. These filings are emotional and high-stakes, and they also have to meet strict procedural rules for service, financial disclosure, and parenting plans. Clean, accurate paperwork keeps the focus on getting a workable outcome for the family instead of getting derailed by technical problems that delay hearings or force amended filings.

Important Notice

This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
