2. RECITALS

3. FINANCIAL DISCLOSURE
3.1 Full Disclosure Obligation
Each Party has made a full, complete, and accurate disclosure of all assets, debts, income, and financial obligations to the other Party, consistent with the fiduciary duties imposed by California Family Code § 721. The disclosures are attached hereto as:

3.2 Representations and Warranties
Each Party represents and warrants that:

This Agreement may only be modified by a written instrument signed by both Parties.
9.3 No Waiver
The failure of either Party to enforce any provision shall not constitute a waiver of such provision.
9.4 Children
Nothing in this Agreement shall predetermine child custody, visitation, or child support. Such matters remain subject to the jurisdiction and discretion of the court under California Family Code §§ 3000 et seq. and §§ 4050 et seq.

CALIFORNIA-SPECIFIC NOTES
- Community Property State: California is a community property jurisdiction. Absent a valid agreement, all property acquired during marriage is presumed community property (Fam. Code § 760).
- Fiduciary Duty: Spouses owe each other the highest duty of good faith and fair dealing (Fam. Code § 721). Postnuptial agreements are subject to heightened scrutiny.
