Section 2.2 Authority to Convey
Pursuant to N.D.C.C. § 30.1-18-11 (3-711), a personal representative has the same power over the title to estate property that an absolute owner would have, in trust for the benefit of creditors and others interested in the estate. Pursuant to N.D.C.C. § 30.1-18-15 (3-715), the Personal Representative may, among other transactions, acquire or dispose of an asset, including land, for cash or on credit, at public or private sale. Under N.D.C.C. § 30.1-18-04 (3-704), the Personal Representative may proceed to administer and distribute the estate without adjudication, order, or direction of the court, except where the Probate Code requires otherwise.

ARTICLE IV: LIMITED / FIDUCIARY WARRANTY
Section 4.1 Special (Limited) Warranty by Fiduciary
The Grantor, solely in the representative capacity and not individually, warrants and will defend the title to the property against the lawful claims and demands of all persons claiming by, through, or under the Grantor in the Grantor's capacity as Personal Representative, but against none other. This deed conveys only such title as the Decedent held at death and as the Estate is empowered to convey, and, where made in kind to a distributee, serves under N.D.C.C. § 30.1-20-07 (3-907) as evidence of the distributee's title.
Section 4.2 Limitation of Warranty
NOTICE: This is a PERSONAL REPRESENTATIVE'S DEED with limited (special) warranty. The Grantor makes NO general warranty and does NOT warrant against defects, liens, encumbrances, or claims arising prior to or independent of the Estate's administration, nor against claims of persons not claiming through the Grantor in the fiduciary capacity. The individual serving as Personal Representative incurs no personal liability by executing this deed in the representative capacity.
ARTICLE V: EXCEPTIONS AND RESERVATIONS
