SECTION 8 / SUBSIDIZED HOUSING. If your tenancy is subsidized under a federal program (HCV, Project-Based, Public Housing, USDA RD), federal good-cause and notice rules apply, and the Public Housing Authority must receive copies of all notices. Termination procedures may differ.


7. RESERVATION OF RIGHTS

The Owner expressly reserves all rights and remedies, including the right to:

  1. Recover all rent due, additional rent, late fees, and damages permitted by the lease and Utah law;
  2. Pursue treble damages under Utah Code § 78B-6-811(3);
  3. Recover reasonable attorney fees and costs;
  4. Apply the security deposit consistent with Utah Code § 57-17-3 to lawful charges;
  5. Refuse partial payment and proceed with unlawful detainer notwithstanding partial tender;
  6. Withdraw, supplement, or amend this Notice in writing.

10. DRAFTING AND SERVICE NOTES

Issue Practice Pointer
Three BUSINESS days, not calendar. Utah Code § 78B-6-801 defines "business day" to exclude weekends and state holidays. Carefully calendar the cure deadline.
Demand only rent. Utah courts narrowly construe "rent." Late fees, attorney fees, and damages are not "rent" unless the written lease so defines and Utah law permits.
Strict construction. Defective amount, defective service, or defective alternatives (pay-only / vacate-only) are dispositive defenses. Restart the notice if any defect is present.
Combined Pay-or-Comply notice. Utah Code § 78B-6-802 also recognizes a 3-business-day "pay or comply or quit" alternative when both rent and a curable lease covenant are at issue. Use the Cure-or-Quit template for non-monetary breaches.
15-day no-cause notice. Month-to-month tenancies may be terminated without cause on 15 calendar days' written notice — see the No-Cause Termination template.
Holdover after fixed term. A tenant remaining after expiration without renewal is in unlawful detainer without further notice (§ 78B-6-802(1)(a)) — but service of a courtesy notice is recommended.
Section 8 tenants. HUD requires "good cause" termination and a copy of the notice to the PHA. A 3-day notice alone is insufficient for federally subsidized units.
Mobile home park tenants. Different statutory scheme under Utah Code Title 57, Chapter 16 (Mobile Home Park Residency Act) — do NOT use this notice.
CARES Act. For "covered properties" (federally backed mortgage / LIHTC / federal subsidy), 30-day notice to vacate may still be required (15 U.S.C. § 9058(c)).
Service trail. Photograph posting; retain certified mail receipts; have a non-party server when feasible.
