12. PRACTITIONER NOTES — OREGON
Statutory and Rule Framework
- ORCP 9 governs service and filing of pleadings and other papers. Service can be made by electronic means, email, personal delivery, or mail.
- ORCP 17 requires that every pleading, motion, or other paper be signed by at least one attorney of record or by the party if unrepresented.
- ORS 9.241 provides that appearance by attorney constitutes the party's appearance.
- UTCR 21.080 mandates electronic filing for attorneys in all Oregon circuit courts.
- UTCR 5.170 governs limited scope representation, including specific filing and notice requirements.
- UTCR 3.170 governs pro hac vice admission, requiring association with an active OSB member.
Judicial Districts and County Considerations
- Oregon has 27 judicial districts covering 36 counties.
- Some districts encompass multiple counties (e.g., the 18th Judicial District covers Clackamas County; the 4th Judicial District covers Multnomah County).
- Multnomah County and Washington County have Supplemental Local Rules (SLRs) that may impose additional requirements, including mandatory service list filings (SLR 2.501 et seq.).
- Lane County, Marion County, and Jackson County may have specialized presiding judge requirements.
Key Practice Points
-
Mandatory E-Filing: E-filing through Oregon eCourt is mandatory for all attorneys in all circuit courts. Self-represented litigants are encouraged but not required to e-file.
-
UTCR 2.010 Formatting: All documents must comply with UTCR 2.010 formatting requirements. Non-compliant documents may be rejected by the court.
-
Limited Scope Representation (UTCR 5.170): Oregon has a well-developed framework for limited scope appearances. Attorneys must file a Notice of Limited Scope Representation as soon as practicable and must file a Notice of Completion upon concluding the limited engagement. No motion to withdraw is required for proper limited scope termination.
-
Withdrawal Requirements (UTCR 3.140): For general appearances, withdrawal requires compliance with UTCR 3.140, which may necessitate court approval and advance notice to the client. The attorney must ensure the client's interests are not prejudiced.
-
Service by Email: Under ORCP 9 B(6), service may be made by email to an address designated by the party for such purpose. Maintain records of email service for contested service issues.
-
Pro Hac Vice (UTCR 3.170): Out-of-state attorneys must associate with an active OSB member, file a motion, and pay the required fee. The court must issue an order granting the admission.
-
Supplemental Local Rules: Always check the SLRs for the specific county where you are filing. Multnomah, Washington, Clackamas, and Lane Counties have notably detailed supplemental rules.
-
Document Retention: Because Oregon eCourt purges documents from File & Serve after 30 days, maintain your own copies of all filings and service confirmations.
Common Errors to Avoid
- Failing to register for Oregon eCourt before attempting to file
- Not checking Supplemental Local Rules for the specific county
- Omitting the Notice of Limited Scope Representation when entering a limited appearance under UTCR 5.170
- Neglecting to file a Notice of Completion upon concluding limited scope representation
- Failing to maintain proof of service receipts from eCourt

All filings must be reviewed and approved by a licensed Oregon attorney before submission to any court. Verify all statutory citations and local court rules before use, as rules and fees may change.
About This Template
These are the filings that drive a lawsuit through the system: complaints, answers, motions, briefs, discovery requests and responses, and post-judgment papers. Each has its own format requirements under federal and state procedural rules, and each has a deadline that cannot be missed without consequences. Clean, procedurally correct filings move a case forward; sloppy ones invite motions to strike, amended responses, and avoidable delays.
Important Notice
This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
