XV. PRACTICE TIPS AND GUIDANCE

Caption Requirements (ORS 21.105)

  1. The caption of any complaint commencing a civil proceeding must include a reference to the ORS section that establishes the applicable filing fee (e.g., "Filing Fee: ORS 21.160").
  2. If the action is subject to ORS 21.160 (tort or contract), the caption must also state the amount in controversy tier.
  3. The "amount claimed" does not include attorney fees or costs and disbursements (ORS 21.160(4)).

Damages Pleading Restrictions (ORCP 18 A)

  1. Oregon prohibits specifying a dollar amount for non-economic damages (pain and suffering, emotional distress) in the complaint itself. State only that the prayer "exceeds $10,000" and disclose the actual amount on this Cover Sheet.
