12. EFILING AND PROCEDURAL INSTRUCTIONS
Filing Requirements
-
KYeCourt eFiling: In courts participating in the KYeCourt project, this Notice of Appearance must be filed electronically. Filing an Entry of Appearance or other supported document electronically makes the attorney an eFiler in the case.
-
Filing Fee: Confirm with the Circuit Clerk whether a separate appearance or entry fee is required. Some circuits (e.g., Jefferson Circuit Court) have specific local requirements.
-
Document Format: Documents filed through KYeCourt must be in PDF format. Ensure all signatures comply with KYeCourt electronic signature requirements.
-
Local Rules: Kentucky has 57 judicial circuits, many with local rules of practice. Verify compliance with applicable local rules by consulting the Kentucky Court of Justice website or the Clerk's office.
Service Requirements Under CR 5.02
- Service upon a party represented by an attorney shall be made upon the attorney.
- Service may be made by delivering a copy, mailing a copy, or transmitting electronically with consent.
- When service is made through KYeCourt, the system's electronic notification constitutes service on all registered eFilers.
Important Deadlines and Considerations
- Responsive Pleading: Filing a Notice of Appearance does not extend the time to file responsive pleadings. If deadlines have passed, separate relief must be sought.
- Withdrawal: Withdrawal of appearance requires compliance with applicable rules and local orders. The Court's permission is typically required, especially if withdrawal would delay proceedings.
- Multiple Parties: If representing multiple parties, ensure no conflict of interest exists and consider whether separate notices should be filed.
13. PRACTITIONER NOTES -- KENTUCKY-SPECIFIC
Commonwealth Terminology
- Kentucky is a Commonwealth; court documents use "Commonwealth of Kentucky" rather than "State of Kentucky."
- Criminal cases are styled "Commonwealth of Kentucky v. [Defendant]"; civil cases use private party names.
Court Structure
- Circuit Court: General jurisdiction; civil cases over $5,000; equity matters.
- District Court: Limited jurisdiction; civil cases up to $5,000; small claims; traffic.
- Family Court: Domestic relations; juvenile; dependency, neglect, and abuse.
57 Judicial Circuits
- Some circuits encompass a single county; others cover multiple counties.
- Each circuit may have its own local rules of practice. Always check local rules before filing.
- Local rules are available at the Kentucky Court of Justice website (kycourts.gov).
KBA Registration
- All attorneys must maintain current registration with the Kentucky Bar Association (SCR 3.022).
- KBA numbers must be included on all pleadings and filings (CR 11).
Filing Fees (Subject to Change)
- Circuit Court civil filing fees and appearance fees vary by circuit. Confirm the current amount with the Clerk.
- Pro hac vice KBA fee: $310.00 plus $7.75 administrative fee.
Electronic Signature
- Under KYeCourt Administrative Procedures, an electronic signature is treated as a personal signature for purposes of CR 11 and all other Kentucky Rules of Civil Procedure.
Key Differences from Federal Practice
- Kentucky uses "Civil Rules" (CR) rather than "Rules of Civil Procedure."
- No local counsel requirement for in-state attorneys, but required for pro hac vice admissions.
- Discovery rules follow CR 26-37, which closely parallel but are not identical to the Federal Rules.
This template is designed for use in Kentucky Circuit, District, and Family Courts. Verify all rule citations and local requirements before filing. Court rules and administrative procedures are subject to change.
About This Template
These are the filings that drive a lawsuit through the system: complaints, answers, motions, briefs, discovery requests and responses, and post-judgment papers. Each has its own format requirements under federal and state procedural rules, and each has a deadline that cannot be missed without consequences. Clean, procedurally correct filings move a case forward; sloppy ones invite motions to strike, amended responses, and avoidable delays.
Important Notice
This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
