Alaska Month-to-Month Rental Agreement

ALASKA MONTH-TO-MONTH RENTAL AGREEMENT

1. Parties and home

2. Monthly term and rent

The charge applies only if the completed amount and trigger are lawful; it is recorded separately from periodic rent. No daily or compounded charge is created by this Agreement.

3. Deposits and prepaid rent

Security deposit: $[________]. Prepaid rent, if any: $[________] for [PERIOD]. Their combined amount must not exceed two months' periodic rent unless an exception in AS 34.03.070 applies. The statutory cap does not apply to a unit whose rent exceeds $2,000 a month.

Landlord will promptly deposit these funds in a trust account wherever practicable, keep them separate from other funds, account for them by tenant, and provide the conditions for withholding them. At termination, Landlord may deduct accrued rent and covered damage caused by Tenant's noncompliance, excluding normal wear and tear and damage caused by Landlord's failure to meet statutory duties. Landlord will send the written itemization and refund to Tenant's last known address. After compliant periodic-tenancy notice and delivery of possession, the ordinary deadline is 14 days; it is 30 days after termination when covered damage costs are deducted. When Tenant gives no compliant notice, Landlord will also observe the separate 30-day rule in AS 34.03.070(g). Tenant's forwarding address, if known: [________________________________].

4. Condition, care, and use

Landlord will keep the premises fit and habitable, maintain common areas, and maintain the supplied or required building systems and appliances as required by AS 34.03.100. Repair and emergency contact: [NAME, PHONE, EMAIL].

Tenant will keep the occupied areas clean and safe as their condition permits; dispose of waste safely; use systems and appliances reasonably; avoid negligent or deliberate damage; and avoid unreasonable disturbance of neighbors. Tenant will promptly report needed repairs to [CONTACT AND METHOD].

5. Entry

Tenant will not unreasonably withhold consent to entry for a purpose permitted by AS 34.03.140. Except in an emergency or when notice is impracticable, Landlord will give at least 24 hours' notice, enter at a reasonable time, and obtain Tenant's consent. 6. Ending the tenancy

While this tenancy remains month to month, either party may terminate it by written notice given at least 30 days before the rental due date stated in that notice. The parties will identify the applicable rental due date from Section 2. A notice for nonpayment, breach, or another ground must follow the separate law governing that ground.

Notices under this Agreement must be in writing. The parties agree to use personal delivery, delivery at the dwelling when the recipient is absent, or registered or certified mail, as applicable; the sender will retain proof of delivery or mailing. A landlord's notice to quit used to recover possession must meet AS 09.45.100 and other applicable notice requirements. Neither party may change a statutory notice period or service rule by this Agreement.

Any amendment must be in writing and signed by Landlord and Tenant. A term that conflicts with nonwaivable law is ineffective to that extent; the remaining lawful terms continue. This Agreement creates no attorney-fee promise, liability waiver, indemnity, or self-help right.
