Wyoming requires two pre-lien notices: a Notice of Right to Lien (preliminary notice) and a Notice of Intent to Lien.

XIII. LIEN PRIORITY

A. General Priority Rules

Under Wyoming law, mechanics liens generally:

  • Have priority over mortgages, liens, and encumbrances that attach after the commencement of the improvement
  • Are subordinate to interests recorded before the commencement of the improvement
  • Are on equal footing with other mechanics liens on the same project

B. Relation-Back Doctrine

Wyoming mechanics liens relate back to the date of commencement of the improvement.


XIV. LIEN RELEASE AND BONDING PROVISIONS

A. Release of Lien (Wyo. Stat. § 29-2-114)

Upon full payment of the lien claim (including interest and costs), the Claimant must file a release of lien with the County Clerk within a reasonable time.

B. Bonding Off the Lien (Wyo. Stat. § 29-2-115)

The owner or any interested party may file a surety bond to release the property from the lien. The bond must be:

  • In a sufficient amount to cover the lien claim plus costs (typically 150% of the lien amount)
  • Issued by a surety authorized to do business in Wyoming
  • Filed with the court

C. Frivolous Lien

If a lien is filed without reasonable basis, the owner may seek damages, costs, and attorney's fees.


XV. ENFORCEMENT

A. Enforcement Deadline (Wyo. Stat. § 29-2-110)

An action to foreclose or enforce the lien must be commenced within 180 days (approximately 6 months) after the filing of the lien statement. If no action is commenced within 180 days, the lien ceases to exist.

CRITICAL: Wyoming's 180-day enforcement deadline is relatively short. Calendar this immediately upon filing the lien statement.

B. Court of Jurisdiction

Enforcement actions are filed in the Wyoming District Court for the county in which the property is situated.

C. Lis Pendens

Upon commencement of a lien enforcement action, the claimant should file a lis pendens with the County Clerk.


XVI. PRACTICE NOTES

  1. Two Pre-Lien Notices Required. Wyoming requires both (1) a Notice of Right to Lien within 30 days of first furnishing AND (2) a Notice of Intent to Lien at least 20 days before filing. Missing either notice can be fatal.

  2. Different Deadlines by Tier. General contractors have 150 days; subcontractors and suppliers have 120 days. Know your tier.

  3. 180-Day Enforcement Deadline. This is one of the shorter enforcement deadlines in the nation. File suit well before the deadline.

  4. Substantial Completion Trigger. The filing deadline runs from the earlier of last furnishing or substantial completion. Monitor project progress carefully.

  5. Direct Contract Exception. When contracting directly with the owner, the Notice of Right to Lien need only be sent before receiving the first payment.

  6. No State Contractor Licensing. Wyoming does not have a state-wide general contractor licensing requirement (though some municipalities may). This does not affect lien rights.

  7. Verification Required. The lien statement must be verified under oath (notarized). An unverified lien statement is invalid.
