KANSAS-SPECIFIC NOTES

All-Property State: Upon filing for divorce, ALL property owned by either spouse becomes marital property subject to division — including pre-marital property and inheritances (K.S.A. 23-2801).

Equitable Distribution: K.S.A. 23-2802 requires a "just and reasonable" division. There is no presumption of equal division.

Professional Goodwill: Marketable professional goodwill is marital property subject to division (K.S.A. 23-2801(a)).

60-Day Waiting Period: A hearing cannot be held until at least 60 days after service on the respondent (K.S.A. 23-2708).

Residency: The petitioner must have been a resident of Kansas for at least 60 days before filing (K.S.A. 23-2703).
