14. ALASKA JURISDICTIONAL NOTES

  • Residency: At least one spouse must be domiciled in Alaska (physically present with intent to remain). No minimum number of days is required. Military personnel not claiming Alaska residency must be continuously stationed in Alaska for at least 30 days.
  • Waiting Period: 30 days from filing before the court may finalize the dissolution.
  • Grounds: No-fault — incompatibility of temperament causing the irremediable breakdown of the marriage (AS 25.24.200). Fault-based grounds available for contested divorce (AS 25.24.050).
  • Property Classification: Equitable distribution; court divides marital property in a just manner (AS 25.24.160(a)(4)). Alaska uniquely permits opt-in community property via written agreement or trust (AS 34.77).
  • Separate Property: Property acquired before marriage or by gift/inheritance generally remains separate.
  • Spousal Maintenance: Awarded based on factors in AS 25.24.160(a)(2); no statutory formula. Courts consider length of marriage, standard of living, earning capacity, and financial resources.
  • Filing: Superior Court; joint petition (DR-100) for uncontested dissolution.
