California Landlord Notice of Entry

California Entry Gate

Cal. Civil Code § 1954 allows entry only for listed purposes. Ordinary notice must be reasonable and written, state the date, approximate time, and purpose, and entry must be during normal business hours; 24 hours is generally presumed reasonable and 6 days is presumed reasonable for mailing. A tenant-requested pre-move-out inspection instead requires at least 48 hours' prior written notice under § 1950.5(f)(1), unless both parties sign a written waiver. Sale showings and agreed repair/service entries have special routes. Emergency, present-tenant consent, and abandonment/surrender can remove the § 1954 notice requirement.

Legal authority

  • Cal. Civ. Code § 1954
  • Cal. Civ. Code § 1950.5(f) (Tenant-requested initial inspection)

Landlord-tenant paperwork governs who can stay in a property, on what terms, and what happens when something goes wrong. Leases, notices to quit, security deposit demands, and habitability complaints all have state and often city-specific requirements for timing, content, and service. Getting the paperwork right is what makes an eviction actually succeed or a security deposit actually come back, because judges regularly dismiss cases over small procedural mistakes.
