PRACTITIONER NOTES

Michigan-Specific Protest Procedures

  1. Deadline Compliance is Critical. The protest must be received by the date and time specified in the solicitation. Late protests will not be considered.

  2. Final Decision. The Chief Procurement Officer's decision on the protest is final. There is no formal administrative appeal beyond the CPO.

  3. Automatic Stay. Until issuing a final decision on a timely protest, DTMB will not finalize the award.

  4. Focus Areas. Focus on:
    - Michigan statutes violated (MCL 18.1261 et seq., preferences)
    - DTMB procurement policies not followed
    - Solicitation instructions not followed

  5. Protests That Cannot Be Upheld. Per DTMB policy, protests cannot be upheld for:
    - Failure to follow solicitation submission instructions
    - Late submissions
    - Failure to provide required samples, literature, or documents
    - Failure to provide required deposits or bonds
    - Late protest filing

  6. Specification Protests. DTMB will generally not withdraw an award recommendation when a protest claims specifications were faulty, unless it determines doing so is in the State's best interest.

  7. Complete Submission. Only information provided within the protest period will be considered. Submit all evidence with the initial protest.

Hi! I can rewrite every section of this to your exact case in about 5 minutes. Heads up: I'm $49 for a one-shot, or $249/mo if you want unlimited docs. But that's still less than 10 minutes of what a lawyer charges to even look at this. Want me to do it?

About This Template

Administrative law covers how you interact with government agencies, from filing a comment on a proposed rule to appealing a denied license or benefit. Agency processes have their own forms, deadlines, and evidence standards that are different from what courts use. Getting the paperwork wrong usually means missing a deadline or losing the right to appeal, so precision in these documents matters as much as it does in a courtroom filing.

Important Notice

This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
