OVERVIEW OF KENTUCKY PROCUREMENT PROTEST LAW

Kentucky's procurement system is governed by the Kentucky Model Procurement Code (KMPC), codified at KRS Chapter 45A. The Finance and Administration Cabinet ("Cabinet") oversees state procurement, and the Secretary of the Finance and Administration Cabinet ("Secretary") has authority to determine bid protests. PROTEST REVIEW PROCESS

Secretary's Determination

  1. No Formal Hearing: Under Kentucky law, no formal evidentiary hearing is available to the protester. The Secretary's determination is made on the written record.

REMEDIES AVAILABLE

  • Cancel the solicitation -- The Secretary may direct the Agency to cancel the procurement
  • Cancel the award -- The Secretary may direct that the award to the awardee be canceled
  • Rescore the proposals -- The Secretary may direct the Agency to rescore bids or proposals
