FILING REQUIREMENT NOTICE: A completed case filing cover sheet must accompany every new civil case filing in a Kansas District Court. A new case will not be accepted by the Clerk without a cover sheet attached. The cover sheet is used by the Clerk for initiating the civil docket sheet, case classification, docket-fee assessment, and statistical reporting. The official cover sheet form is published by the Kansas Judicial Council and is available at kjc.ks.gov. XVIII. PRACTICE TIPS FOR KANSAS CIVIL FILINGS

Venue: Kansas venue rules are found at K.S.A. 60-602 et seq. In general, venue is proper where the defendant resides or where the cause of action arose. For actions involving real property, venue is in the county where the property is located (K.S.A. 60-604).

Statutes of Limitation: The general statute of limitations for personal injury in Kansas is two years (K.S.A. 60-513). For breach of written contract, five years (K.S.A. 60-511). For breach of oral contract, three years (K.S.A. 60-512). Medical malpractice must be brought within two years from the date of the act or omission (K.S.A. 60-513(c)).

Medical Malpractice Screening Panels: Under K.S.A. 65-4901 et seq. (the Kansas Health Care Provider Insurance Availability Act), medical malpractice claims against healthcare providers who participate in the Health Care Stabilization Fund must be submitted to a screening panel before filing suit.

Service of Process: Kansas permits personal service by sheriff, certified mail, residential service, and private process servers (K.S.A. 60-303). Service must be obtained within 90 days of filing (K.S.A. 60-203(a)).

Limited Actions vs. Regular Civil: Kansas differentiates between "Limited Actions" (streamlined procedure for smaller claims) and regular Chapter 60 civil actions. The filing classification and docket fee depend on the amount in controversy. Review Kansas Supreme Court Rule 140 for Limited Action procedures.

Jury Demand Timing: Under K.S.A. 60-238(b), a jury demand must be served within 14 days after the last pleading on the issue. Failure to timely demand a jury waives the right.
