XVIII. PRACTICE TIPS FOR KANSAS CIVIL FILINGS

1. Venue: Kansas venue rules are found at K.S.A. 60-602 et seq. In general, venue is proper where the defendant resides or where the cause of action arose. For actions involving real property, venue is in the county where the property is located (K.S.A. 60-604).

2. Statutes of Limitation: The general statute of limitations for personal injury in Kansas is two years (K.S.A. 60-513). For breach of written contract, five years (K.S.A. 60-511). For breach of oral contract, three years (K.S.A. 60-512). Medical malpractice must be brought within two years from the date of the act or omission (K.S.A. 60-513(c)).

3. Medical Malpractice Screening Panels: Under K.S.A. 65-4901 et seq. (the Kansas Health Care Provider Insurance Availability Act), medical malpractice claims against healthcare providers who participate in the Health Care Stabilization Fund must be submitted to a screening panel before filing suit.

4. Service of Process: Kansas permits personal service by sheriff, certified mail, residential service, and private process servers (K.S.A. 60-303). Service must be obtained within 90 days of filing (K.S.A. 60-203(a)).

5. Limited Actions vs. Regular Civil: Kansas differentiates between "Limited Actions" (streamlined procedure for smaller claims) and regular Chapter 60 civil actions. The filing classification and docket fee depend on the amount in controversy. Review Kansas Supreme Court Rule 140 for Limited Action procedures.

6. Jury Demand Timing: Under K.S.A. 60-238(b), a jury demand must be served within 14 days after the last pleading on the issue. Failure to timely demand a jury waives the right.

7. E-Filing: Kansas is rolling out mandatory electronic filing through the eCourt system. Check whether your judicial district requires e-filing. The Kansas Judicial Council website (kjc.ks.gov) has current information on participating courts.

8. Poverty Affidavit: Under K.S.A. 60-2001(b), the affidavit must include specific factual information about income and inability to pay. The Kansas Judicial Council publishes a model form. If the court determines the litigant is not impoverished, the court may assess fees and costs.
