Indiana Jury Demand Rules:
- Under T.R. 38(B), a party may demand a jury trial by serving a written demand on all other parties no later than 10 days after the first responsive pleading is due or within the time set for a responsive pleading by court order.
- The demand must specify the issues to be tried by jury.
- Failure to make a timely demand constitutes a waiver of the right to jury trial (T.R. 38(D)), unless the court grants relief under T.R. 39(B).

Service Deadlines and Methods:
- Under T.R. 4(B), if service is not made within one year after filing the complaint, the case is subject to dismissal.
- Certified mail is the most common method (T.R. 4.1(A)(3)) — service is complete when the return receipt is received.

XII. ELECTRONIC FILING — INDIANA E-FILING SYSTEM (IEFS)
Indiana has implemented statewide mandatory e-filing through the Indiana E-Filing System (IEFS), operated by the Indiana Office of Court Technology under Administrative Rule 16.

XV. PRACTICE TIPS AND GUIDANCE
Court Selection
- Circuit Court is the court of general jurisdiction in each of Indiana's 92 counties (IC 33-28-1-2). Every county has at least one Circuit Court.
- Superior Court is available in most counties and has concurrent jurisdiction with the Circuit Court for civil matters (IC 33-29-1-1.5).
- Small Claims Courts handle disputes where the amount in controversy does not exceed $10,000 (IC 33-34-3-2). Attorneys may represent parties in small claims.
- Commercial Courts are available in designated counties (e.g., Marion County) for complex business disputes. Check the Indiana Supreme Court's Commercial Court designation orders.
Case Numbering (Admin. Rule 8)
- The Indiana uniform case number consists of four groups: (1) court code (county + court number), (2) year and month of filing, (3) two-letter case type code, and (4) sequential filing number. Example: 49D01-2603-CT-000123.
- The case type code is critical for proper docketing. Misclassification may result in incorrect fee assessment or routing.
Venue
- Venue is generally proper in the county where the defendant resides, where the cause of action arose, or where the real property at issue is located (T.R. 75).
- A motion for change of venue from the county must be filed within 60 days of the initial filing or 10 days after the opposing party's first appearance, whichever is later (T.R. 76).
- A motion for change of judge (change of venue from the judge) must be filed within 30 days of the first hearing or 30 days after the issues are first closed on the merits, whichever occurs first (T.R. 76).
Medical Malpractice
- Indiana has a Medical Malpractice Act (IC 34-18) that requires proposed complaints to be filed with the Indiana Department of Insurance before filing suit in court.
- A medical review panel must render an opinion before the action can proceed in court (IC 34-18-8 et seq.).
- Damages in medical malpractice cases are capped at $1,800,000 for acts occurring on or after July 1, 2019 (IC 34-18-14-3).
- The qualifying health care provider pays the first $500,000; the Indiana Patient's Compensation Fund covers amounts above $500,000 up to the cap.
Statute of Limitations
- General personal injury: 2 years (IC 34-11-2-4)
- Contract: 6 years for written contracts, 6 years for oral contracts (IC 34-11-2-7; IC 34-11-2-9)
- Property damage: 2 years (IC 34-11-2-4)
- Medical malpractice: 2 years from the act, omission, or neglect (IC 34-18-7-1)
Service Notes
- Indiana Trial Rules 4 through 4.17 provide detailed service requirements. The most common methods are personal service, service at dwelling, and certified mail.
- Service by certified mail is considered "complete" when the return receipt is received by the Clerk showing delivery or refusal (T.R. 4.1(A)(3)).
