15.3 Indiana-Specific Procedural Notes

  1. Medical Malpractice — Proposed Complaint: Under the Indiana Medical Malpractice Act (IC 34-18), medical malpractice claims must first be submitted to the Indiana Department of Insurance for a medical review panel before filing in court. File a proposed complaint with the Department of Insurance.

  2. Comparative Fault: Indiana follows modified comparative fault (IC 34-51-2-6). A plaintiff who is more than 50% at fault is barred from recovery. Damages are reduced by the plaintiff's percentage of fault.
