WHEREAS, the Assignor intends that, from and after the effective date of this Assignment, all property described herein shall be owned beneficially by the Trust and shall be administered by the Trustee in accordance with the Trust's terms;
NOW, THEREFORE, the Assignor hereby assigns, transfers, conveys, and delivers the property described below to the Trustee.
IV. ASSIGNMENT — SCOPE
The Assignor hereby ASSIGNS, TRANSFERS, CONVEYS, AND DELIVERS to the Trustee, to be held under the terms of the Trust, the following:

C. After-Acquired Property
This Assignment extends to property of the foregoing categories acquired by the Assignor after the effective date of this Assignment, to the maximum extent permitted by applicable law, until this Assignment is revoked or amended in writing.
V. EXCLUSIONS — SEPARATELY TITLED ASSETS NOT COVERED
This Assignment DOES NOT effect transfer of the following categories of assets. Each must be transferred to the Trust (or designated to the Trust) by a separate, asset-specific instrument:
| Asset Category | Required Transfer Mechanism |
|---|---|
| Real property | Recorded deed (quitclaim, warranty, or fiduciary deed) |
| Motor vehicles | DMV title transfer in trustee's name |
| Boats / vessels | State and/or USCG title transfer |
| Aircraft | FAA registration transfer |
| Bank accounts, CDs, money-market accounts | Institution retitling with trust certification |
| Brokerage and securities accounts | Broker retitling and signature update |
| Certificated securities | Stock-power assignment + transfer agent recordation |
| Retirement accounts (IRA, 401(k), 403(b)) | Beneficiary designation (NOT ownership transfer) |
| Life insurance and annuities | Beneficiary designation (and/or ownership transfer for ILIT) |
| Closely held business interests | Assignment per operating agreement / bylaws / buy-sell |
| Partnership and LLC interests | Assignment per operating / partnership agreement |
| Promissory notes / mortgages held as payee | Endorsement, assignment, and (for mortgages) recording |
| Registered intellectual property | USPTO / Copyright Office recordation |
| Safe-deposit box contents | Depends on institution agreement; physical contents pass under this Assignment |
This Assignment also does not apply to:
- Property the Assignor specifically devises by Will or by separate instrument
- Property the Assignor has previously and effectively transferred to another owner
- Property held in joint tenancy or by the entirety with a non-trustee co-owner, except to the extent of the Assignor's individual interest
- Property that the terms of the Trust expressly exclude
VI. SCHEDULE A — NON-EXCLUSIVE ITEMIZATION
The Assignor has attached Schedule A as a non-exclusive itemization of significant items intended to be transferred. Schedule A is illustrative only. The omission of any item from Schedule A shall not be construed to exclude that item from this Assignment if it otherwise falls within the categories assigned above.
VII. REVOCABILITY
This Assignment is revocable to the same extent that the Trust is revocable. So long as the Trust is revocable by the Assignor, the Assignor may at any time revoke, amend, or supplement this Assignment by written instrument signed by the Assignor and delivered to the Trustee.
Upon the Assignor's death or the irrevocability of the Trust by its terms, this Assignment shall likewise become irrevocable.
VIII. TAX MATTERS
The parties acknowledge:
-
The Trust is treated as a grantor trust under I.R.C. §§ 671–679 for so long as it is revocable, and the Assignor remains the owner of the assigned property for federal income-tax purposes.
-
This Assignment is not a completed gift for federal gift-tax purposes (Treas. Reg. § 25.2511-2(c)); no Form 709 is required by reason of this Assignment.
-
The Assignor's basis in the assigned property carries over to the Trust; no step-up in basis occurs by reason of this Assignment during the Assignor's lifetime.
-
No state real-property-transfer tax is triggered (real property is not assigned by this instrument; separate deed required).
IX. COORDINATION WITH POUR-OVER WILL
The Assignor's Last Will and Testament dated [__/__/____] contains a pour-over provision directing that any property not effectively transferred to the Trust during the Assignor's lifetime be poured over into the Trust at the Assignor's death. This Assignment is intended to minimize the operation of the pour-over provision by effecting lifetime transfer of qualifying property, but it does not replace or supersede the pour-over provision.
X. GOVERNING LAW; CONSTRUCTION
This Assignment shall be governed by and construed in accordance with the laws of [STATE], which is the governing-law jurisdiction of the Trust. This Assignment shall be construed broadly to effectuate the Assignor's intent to fund the Trust with all qualifying property.
XI. ACCEPTANCE BY TRUSTEE
The Trustee acknowledges receipt of the property described in this Assignment and accepts the same as trust property to be held and administered under the terms of the Trust.

This General Assignment should be executed contemporaneously with (or shortly after) the Trust instrument and retained in the permanent trust records. It is a complement to — not a substitute for — asset-specific retitling. Failure to separately retitle real estate, accounts, vehicles, registered securities, and similar assets will leave those assets outside the Trust, and they will pass through probate or via beneficiary designation as applicable.

Estate planning documents decide what happens to your property, your children, and your medical care when you cannot make those decisions yourself. Wills, trusts, powers of attorney, and health care directives each serve different purposes and each have to meet state law requirements for signing, witnessing, and notarization. A document that looks fine on the page but was not executed correctly can be rejected in probate, which is exactly when it is too late to fix.
