North Carolina Former-Tenant Personal Property Notice

Select one route and delete the others. Do not use the voluntary-abandonment route merely because the unit appears empty; § 42-25.9(e) requires clear evidence or completion of the statutory suspected-abandonment posting period.

Route Selection

☐ Route A — Writ executed; total property value under $500. Property is deemed abandoned five days after execution. The tenant may request release before the five-day period expires.

☐ Route B — Writ executed; general seven-day hold or planned sale. The landlord may move property for storage but may not dispose of it during the seven-day period. A planned public or private sale requires first-class mailed notice at least seven days before sale.

☐ Route C — Voluntarily vacated; property worth $750 or less transferred to qualifying nonprofit. The nonprofit must identify and separately store the property for 30 days and release it at no charge. The landlord must post and mail the statutory recipient notice, without describing the property.

Legal authority

  • N.C. Gen. Stat. § 42-25.9
  • N.C. Gen. Stat. § 42-36.2

Landlord-tenant paperwork governs who can stay in a property, on what terms, and what happens when something goes wrong. Leases, notices to quit, security deposit demands, and habitability complaints all have state and often city-specific requirements for timing, content, and service. Getting the paperwork right is what makes an eviction actually succeed or a security deposit actually come back, because judges regularly dismiss cases over small procedural mistakes.
