Dear [________________________________]:

I. INTRODUCTION AND NATURE OF DEMAND

This firm represents [________________________________] ("our client") in connection with a first-party property damage claim under Rhode Island law arising from damage to the insured property located at [________________________________], Rhode Island. This letter constitutes a formal demand for full payment of all policy benefits owed under Policy No. [________________________________].

[________________________________] (the "Company") has [☐ failed to pay / ☐ grossly underpaid / ☐ unreasonably delayed payment of] our client's covered loss despite clear coverage, thorough documentation, and the passage of [____] days since the date of loss on [__/__/____]. Under Rhode Island's Unfair Claims Settlement Practices Act, R.I. Gen. Laws § 27-9.1-4, and the Company's obligations under R.I. Gen. Laws § 9-1-33, such conduct is not permissible.

This demand expires at 5:00 p.m. Eastern Time on [__/__/____]. Failure to respond with a reasonable offer to pay all benefits owed will result in litigation, a bad faith claim, and a complaint with the Rhode Island Department of Business Regulation, Insurance Division.

II. RHODE ISLAND PROPERTY INSURANCE LAW — STATUTORY FRAMEWORK

A. Standard Fire Policy: R.I. Gen. Laws § 27-5-3

Rhode Island property insurance policies covering fire are governed by the mandatory standard fire policy prescribed in R.I. Gen. Laws § 27-5-3. No insurer may issue a policy on any property in Rhode Island providing fire coverage on terms less favorable to the insured than those required by § 27-5-3. The statute sets baseline coverage obligations, proof-of-loss procedures, and time deadlines that inure to the insured's benefit.

B. Unfair Claims Settlement Practices: R.I. Gen. Laws § 27-9.1-4

Rhode Island's Unfair Claims Settlement Practices Act, R.I. Gen. Laws § 27-9.1-4 (Chapter 27-9.1), establishes minimum standards for insurer conduct. Relevant requirements include:

  • Acknowledgment within 10 days of receipt of a claim communication
  • Decision on coverage within 30 days of receipt of proof of loss (unless the insured agrees to an extension)
  • Adoption and implementation of reasonable standards for prompt investigation
  • Good-faith effort to effectuate fair, equitable settlement when liability is reasonably clear
  • Prohibition on unreasonably delaying investigation or payment
  • Obligation to provide a reasonable explanation of any denial or inadequate offer referencing specific policy provisions

A violation of § 27-9.1-4 is considered an "unfair claims settlement practice" and can subject the insurer to regulatory action by the Rhode Island DBR, Insurance Division, and constitutes evidence of bad faith in litigation under R.I. Gen. Laws § 9-1-33.

C. Hurricane Deductibles: R.I. Gen. Laws ch. 27-76 and 230-RICR-20-05-13

For coastal and storm-related claims, Rhode Island has specific hurricane deductible regulations. Under R.I. Gen. Laws § 27-76-2 and 230-RICR-20-05-13:

  • Hurricane deductibles may only be applied when the National Hurricane Center has issued a hurricane warning for the applicable part of Rhode Island
  • The trigger period runs from issuance of a hurricane warning through 24 hours after termination of the last warning
  • The maximum hurricane deductible is 5% of the insured value of the dwelling (Coverage A)
  • Windstorm deductibles (applicable to all wind damage regardless of a hurricane warning) are prohibited in Rhode Island residential policies
  • Insurers must provide "clear and prominent notice" of all hurricane deductibles, including at least two practical examples with actual dollar amounts on the declarations page
  • If a hurricane deductible applies, insurers must furnish credit against the premium
  • The deductible may be waived if the insured has implemented qualifying mitigation measures per applicable building code wind zones

If the Company has applied a deductible that was not properly triggered, or applied a windstorm deductible in excess of the 5% cap, that application is unlawful under Rhode Island law.

Hurricane Deductible Analysis:

D. Bad Faith: R.I. Gen. Laws § 9-1-33

Rhode Island recognizes a statutory first-party bad faith cause of action under R.I. Gen. Laws § 9-1-33. An insured may sue an insurer that wrongfully and in bad faith refuses to pay or settle a claim, or refuses to timely perform its policy obligations. Available remedies include compensatory damages, punitive damages (available as a matter of right without proof of separate willful or wanton conduct, per Skaling v. Aetna Ins. Co., 799 A.2d 997 (R.I. 2002)), and reasonable attorney's fees.

E. Mediation Program: 230-RICR-20-05-13

Following a qualifying hurricane or catastrophic storm event, the Rhode Island Insurance Division may activate a mandatory insurer / voluntary insured mediation program for unresolved property claims. Mediations must be scheduled within 30 days, with three-hour sessions. If the Division activates this program, [________________________________] is required to participate.

F. Statutes of Limitations

Claim Type Period Authority
Contract (policy benefits) 10 years R.I. Gen. Laws § 9-1-13
Tort / bad faith 3 years R.I. Gen. Laws § 9-1-14
Prejudgment interest From date of demand R.I. Gen. Laws § 9-21-10

The date of loss is [__/__/____]. This demand is timely. Prejudgment interest under R.I. Gen. Laws § 9-21-10 will accrue from the date of this demand at the statutory rate.

III. POLICY INFORMATION AND COVERAGE

A. Policy Details

Item Information

Insurer [________________________________]
Policy Period [__/__/____] to [__/__/____]
Property Address [________________________________], RI [________]
Property Type ☐ Single-family ☐ Multi-family ☐ Condo ☐ Rental ☐ Commercial

Coverage C — Personal Property Contents $[________________________________]
Coverage D — Loss of Use / ALE Additional living expenses $[________________________________]
Coverage E — Liability (if applicable) [________________________________] $[________________________________]

C. Coverage Analysis

The loss is clearly covered under the policy and Rhode Island law because:

☐ The cause of loss ([________________________________]) is a covered peril under the policy's insuring agreement
☐ The damage occurred during the policy period ([__/__/____] to [__/__/____])
☐ The damaged property is covered property under Coverage [____]
☐ The loss was not caused by any excluded peril
☐ All policy conditions (prompt notice, cooperation, proof of loss) have been satisfied
☐ The deductible of $[________________________________] has been accounted for in the demand calculation below

[________________________________] has not identified any valid exclusion or condition that bars or limits coverage. [Describe and rebut any coverage defense the insurer has raised:]

[________________________________]

IV. THE LOSS EVENT

A. Description of Loss

On [__/__/____], the insured property at [________________________________], Rhode Island sustained significant damage due to [________________________________].

Detailed Narrative:

[________________________________]

[________________________________]

[________________________________]

B. Cause of Loss

☐ Fire (accidental / electrical / HVAC / arson — exclude if criminal)
☐ Water damage — internal (burst pipe / appliance failure / roof leak)
☐ Wind / windstorm
☐ Hurricane / named storm ([________________________________]) — see hurricane deductible analysis above
☐ Storm surge / coastal flooding — note: standard homeowner policies typically exclude flood; NFIP policy may apply
☐ Hail
☐ Lightning strike
☐ Theft / vandalism
☐ Smoke / soot damage
☐ Ice dam / snow load
☐ [________________________________]

Note on Coastal / Storm Surge Claims: Rhode Island's coastal geography — including Narragansett Bay, Block Island Sound, and the Atlantic coast — creates significant exposure to storm surge, wave action, and coastal flooding. Standard homeowner policies generally exclude flood under the anti-concurrent causation clause. Where a loss involves both wind damage (covered) and flood/storm surge (excluded), Rhode Island law requires the insurer to fairly allocate the covered wind damage from the excluded flood damage and pay for the covered portion. The Company may not use the flood exclusion as a pretext to deny the entirety of a loss that includes covered wind damage. See 230-RICR-20-05-13.

C. Prompt Notice

Our client reported this loss to [________________________________] on [__/__/____] (Claim No. [________________________________]), [____] days after the loss event. Notice was timely under the policy and Rhode Island law.

D. Mitigation Efforts

Our client took immediate and reasonable steps to mitigate further damage as required under the policy and Rhode Island law:

Date Action Taken Provider Cost
[__/__/____] [________________________________] [________________________________] $[________________________________]
[__/__/____] [________________________________] [________________________________] $[________________________________]
[__/__/____] [________________________________] [________________________________] $[________________________________]
Total Mitigation Costs $[________________________________]

All mitigation costs are covered under the policy and reimbursable as a reasonable expense to protect covered property from further damage.

B. Insurer's Position and Our Response

The Company has taken the following position on this claim:

[________________________________]

This position is unreasonable and contrary to Rhode Island law and the policy terms because:

[________________________________]

[________________________________]

Specifically, the Company's [☐ denial / ☐ underpayment / ☐ delay] constitutes a violation of R.I. Gen. Laws § 27-9.1-4 and exposes the Company to bad faith liability under R.I. Gen. Laws § 9-1-33.

TOTAL DUE $[________________________________]

VII. OVERHEAD AND PROFIT

Our client is entitled to general contractor overhead and profit ("O&P") as a component of the repair estimate because:

  • The scope of damage requires coordination of multiple licensed trades (electrical, plumbing, roofing, framing, HVAC, drywall, painting)
  • A general contractor is reasonably necessary to manage this project under Rhode Island licensing law
  • O&P is an industry-standard component of Xactimate and other estimating software at [____]% overhead and [____]% profit

The Company's refusal to include O&P in its estimate is contrary to standard insurance industry practice, Rhode Island case law, and good faith obligations under § 27-9.1-4. We demand inclusion of $[________________________________] in O&P on this claim.

VIII. RECOVERABLE DEPRECIATION (RCV POLICIES)

This policy provides Replacement Cost Value (RCV) coverage. Once repairs are completed or repair contracts are executed, our client is entitled to recover the withheld depreciation of $[________________________________]. The Company must pay recoverable depreciation promptly upon presentment of receipts or a repair contract, and may not impose conditions not stated in the policy. Any undue delay in paying recoverable depreciation after presentment constitutes a violation of § 27-9.1-4.

IX. APPRAISAL DEMAND (IF APPLICABLE)

A. Invoking Appraisal

Due to the Company's failure to fairly evaluate the scope or amount of loss, we hereby invoke the appraisal process as provided in the policy. While Rhode Island has no standalone mandatory appraisal statute, the policy's appraisal clause is enforceable and provides:

[________________________________]

We appoint [________________________________] as our client's appraiser. Please identify the Company's appraiser within [____] days.

B. Scope of Appraisal

The following disputed items are submitted to appraisal (coverage questions are reserved for litigation):

☐ Amount of covered dwelling loss (Coverage A) — scope and pricing
☐ Amount of other structures loss (Coverage B)
☐ Amount of personal property loss (Coverage C)
☐ O&P inclusion
☐ [________________________________]

X. STATUTORY VIOLATIONS AND BAD FAITH

A. Violations of R.I. Gen. Laws § 27-9.1-4

The Company has committed the following unfair claims settlement practices in violation of R.I. Gen. Laws § 27-9.1-4:

☐ Failed to acknowledge claim within 10 days of receipt
☐ Failed to accept or deny coverage within 30 days of proof of loss submission
☐ Failed to provide a reasonable explanation of denial citing specific policy provisions
☐ Failed to conduct a thorough, objective investigation before denying or underpaying the claim
☐ Offered substantially less than the amount owed, compelling litigation
☐ Misrepresented pertinent facts or policy provisions relating to coverage
☐ Applied an improper or unlawfully triggered hurricane deductible
☐ Applied a windstorm deductible prohibited under 230-RICR-20-05-13
☐ Unreasonably delayed payment of undisputed portions of the claim
☐ Failed to notify insured of missing information needed to process the claim
☐ [________________________________]

B. Bad Faith Under R.I. Gen. Laws § 9-1-33

Under Bibeault v. Hanover Ins. Co., 417 A.2d 313 (R.I. 1980), and Skaling v. Aetna Ins. Co., 799 A.2d 997 (R.I. 2002), bad faith requires: (1) the absence of a reasonable basis in fact or law for the insurer's conduct; and (2) the insurer's knowledge of, or reckless disregard of, that lack of reasonable basis. The Company's conduct satisfies both prongs:

No Reasonable Basis:

[________________________________]

Knowledge / Reckless Disregard:

[________________________________]

Available Remedies Under § 9-1-33:

  • Compensatory damages (all underpaid / unpaid policy benefits)
  • Consequential damages (financial losses caused by the denial or delay)
  • Emotional distress damages
  • Punitive damages — available as a matter of right; no additional showing of willful or wanton conduct required (Skaling, 799 A.2d 997)
  • Reasonable attorney's fees
  • Prejudgment interest under R.I. Gen. Laws § 9-21-10

XI. FORMAL DEMAND

A. Monetary Demand

We demand full payment of all benefits owed under the policy:

Item Amount
Coverage A — Dwelling $[________________________________]
Coverage B — Other Structures $[________________________________]
Coverage C — Personal Property $[________________________________]
Coverage D — Loss of Use $[________________________________]
Mitigation / Emergency Services $[________________________________]

☐ Written confirmation that all outstanding claims have been resolved
☐ Correction of any adverse information reported to CLUE or industry databases arising from this claim

Failure to preserve this material may result in spoliation sanctions in subsequent litigation.

XIV. CONCLUSION

[________________________________] sold our client a property insurance policy guaranteeing protection against exactly this type of covered loss. The loss has occurred, the coverage is clear, and the Company's [denial / underpayment / delay] is without reasonable basis. Rhode Island law gives us powerful tools to vindicate our client's rights — but we prefer resolution.

We urge the Company to accept this demand and fulfill its obligations under the policy and Rhode Island law.

Respectfully submitted,

About This Template

A demand letter is a formal written request to fix a problem or pay what is owed, sent before anyone files a lawsuit. It gives the other side a real chance to settle, creates a record of your attempt to resolve things, and in many cases (unpaid debts, insurance claims, broken contracts) starts a legally required response window. A well-written demand letter lays out what happened, what you want, and a deadline to act, which is often enough to get results without ever going to court.

Important Notice

This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
