RE: Demand for Payment of Final Wages — Virginia Payment of Wage Act, Va. Code § 40.1-29; Notice of Treble-Damages Exposure under Va. Code § 40.1-29.2

Dear [EMPLOYER CONTACT]:

I worked for [EMPLOYER NAME] as a [JOB TITLE] from [__/__/____] through my separation on [__/__/____]. My separation was by [☐ involuntary termination ☐ layoff ☐ resignation with [____] days' notice]. As of the date of this letter, [EMPLOYER NAME] has not paid all wages owed.

1. Itemized Wages Owed

Category Period Hours / Units Rate Amount
Regular wages (time actually worked) [__/__/____] – [__/__/____] [____] $[______] $[__________]
Earned commissions [Identify accounts] $[__________]
Earned bonus [Identify plan] $[__________]
Contractual PTO payout (if applicable) Balance as of [__/__/____] [____] hrs $[______] $[__________]
Unauthorized deductions to be restored [Identify] $[__________]
TOTAL UNPAID WAGES $[__________]

2. Statutory Deadline Violated

Under Va. Code § 40.1-29(A)(2), my final wages were due on or before the regular payday for the pay period in which my employment terminated — i.e., [__/__/____]. That deadline has passed by [____] days.

3. Statutory Damages Triggered

Under Va. Code § 40.1-29(J) and § 40.1-29.2, the 2020 wage-theft amendments entitle me, in addition to unpaid wages, to:

  • TREBLE damages (3x the unpaid wages) on a showing that [EMPLOYER NAME] knowingly failed to pay — i.e., an aggregate of $[3x TOTAL];
  • Prejudgment interest at 8% per annum (Va. Code § 6.2-302);
  • Reasonable attorney's fees and costs, mandatory to the prevailing employee under § 40.1-29.2; and
  • A civil penalty of up to $1,000 per violation (§ 40.1-29(E)).

Knowing failure to pay wages aggregating less than $10,000 is a Class 1 misdemeanor; knowing failure to pay aggregating $10,000 or more is a Class 6 felony. Va. Code § 40.1-29.2(A)–(B).

4. Demand

I demand that [EMPLOYER NAME] tender the full sum of $[__________] (unpaid wages) plus trebled-damages exposure of $[2x TOTAL additional] — for a total settlement value of $[__________] — by certified check made payable to me at the address above, on or before [__/__/____] (14 calendar days from the date of this letter).

5. Notice of Anti-Retaliation Protection

I am exercising rights protected by Va. Code § 40.1-33.2. Any adverse action — including, without limitation, negative references, contested unemployment-insurance claims, or threats — exposes [EMPLOYER NAME] to a separate retaliation claim and additional damages.

6. Preservation of Records

You are required to preserve all payroll, time, commission, bonus, and personnel records relating to my employment under Va. Code § 40.1-28.10 and applicable DOLI regulations. Spoliation will be reported to DOLI and pursued as a separate cause of action.

7. Consequences of Non-Payment

If the full amount demanded is not received by [__/__/____], I will, without further notice:

  • (a) File a Claim for Unpaid Wages with the Virginia Department of Labor and Industry, Payment of Wage Unit;
  • (b) Pursue all civil remedies in General District or Circuit Court of Virginia, seeking treble damages plus attorney's fees and costs;
  • (c) Refer the matter to the local Commonwealth's Attorney for criminal prosecution under Va. Code § 40.1-29.2 where the facts warrant; and
  • (d) If applicable, pursue joint-and-several liability against the general contractor of any construction project under Va. Code § 11-4.6.

This letter is sent in good faith to afford [EMPLOYER NAME] a final opportunity to resolve this matter.

Sincerely,

[EMPLOYEE FULL LEGAL NAME]
[SIGNATURE: ____________________________] Date: [__/__/____]

Enclosures: (1) Copy of last pay stub; (2) W-2 / W-4 / offer letter; (3) Commission/bonus plan; (4) Time records.

About This Template

Employment documents govern the relationship between a company and its workers, from offer letters and employment agreements through handbooks, performance reviews, and separations. Done right, they set clear expectations, protect against wrongful termination and discrimination claims, and give both sides a record to rely on. Done poorly, they invite lawsuits, agency complaints, and costly disputes.

Important Notice

This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
