3. STATEMENT OF DUTY AND FILING DEADLINE

Pursuant to Va. Code § 64.2-1300(A), every personal representative or curator shall, within four (4) months after the date of the order conferring his authority (date of qualification), return to the Commissioner of Accounts an inventory of: (i) all personal estate under his supervision and control; (ii) the decedent's interest in any multiple-party account in any financial institution; (iii) all real estate over which he has the power of sale; and (iv) any other real estate that is an asset of the decedent's estate, whether or not situated in the Commonwealth.

Under § 64.2-1300(D), the fiduciary shall place the market value on each item, determined as of the date of death. Under § 64.2-1300(E), after-discovered assets are reported by amended or additional inventory within four months after discovery.

Valuation note (CC-1670 instructions). Report assets as they existed on the date of death, even if they have since changed form. Do not reduce the gross value of any item by the amount of an outstanding mortgage, loan, lien, or other claim against it; encumbrances are noted separately. Real estate may be listed at its locally assessed value.


4. APPRAISAL / VALUATION METHOD

Each item is valued at its fair market value as of the date of the decedent's death (Va. Code § 64.2-1300(D)) — the price at which the property would change hands between a willing buyer and a willing seller, neither under compulsion, both with reasonable knowledge of relevant facts. The personal representative may employ appraisers or other experts to assist; any reasonable expense in determining values is an allowable cost of administration (§ 64.2-1300(D)). Attach an explanation if any method other than fair market value is used for an item.

In listing property pursuant to subsection A, B, or C, the fiduciary shall place the market value on each item. The filing shall be made or the permission granted within four months after the discovery or receipt of the assets."
