3. DUTY AND FILING DEADLINE

Pursuant to K.S.A. 59-1201, within thirty days after the date of the personal representative's letters of appointment (unless a longer time is granted by the Court), the personal representative shall make an inventory stating opposite each item the full and fair value as of the date of death, verified by the personal representative's affidavit, of all real estate and tangible personal property owned by the Decedent and located in Kansas, and of all intangible property wherever located that comes to the personal representative's possession or knowledge. If the Decedent was a member of a partnership, the inventory must contain a separate inventory and valuation of the whole partnership estate and of the Decedent's proportional share.

4. APPRAISEMENT / VALUATION METHOD

Under K.S.A. 59-1202, no independent appraisement is made unless a party having an interest in the estate requests one. ☐ No interested party has requested an independent appraisement; the personal representative states the values by affidavit (K.S.A. 59-1201).
☐ An interested party has requested an appraisement; appraisers have been appointed and approved by the Court (K.S.A. 59-1202) — see Appraisers' Certificate below.

Valuation sources used:

Legal authority

  • K.S.A. 59-1201 (Inventory and valuation; within 30 days after letters of appointment)
  • K.S.A. 59-1202 (Appraisement; appraisers appointed on request of interested party)
  • K.S.A. 59-1203 (Property discovered after filing; supplemental inventory)
  • K.S.A. 53-601 (Unsworn declaration alternative where permitted; statutory exceptions apply)

Estate planning documents decide what happens to your property, your children, and your medical care when you cannot make those decisions yourself. Wills, trusts, powers of attorney, and health care directives each serve different purposes and each have to meet state law requirements for signing, witnessing, and notarization. A document that looks fine on the page but was not executed correctly can be rejected in probate, which is exactly when it is too late to fix.
