ARTICLE XII -- LEGAL AUTHORITY AND ARIZONA-SPECIFIC PROVISIONS

Section 12.1 -- Governing Law

This Digital Asset Inventory is prepared pursuant to and governed by Arizona's Revised Uniform Fiduciary Access to Digital Assets Act, A.R.S. §§ 14-13101 through 14-13117, effective 2016.

Section 12.2 -- Priority of User Directions (A.R.S. § 14-13104)

Under Arizona law, the priority of directions regarding digital asset disclosure is:

  1. Online Tool Direction -- A direction by the user through an online tool provided by the custodian (e.g., Google Inactive Account Manager) takes highest priority.
  2. Estate Planning Document Direction -- A direction in the user's will, trust, power of attorney, or other record takes second priority.
  3. Terms of Service Agreement -- The custodian's terms of service control if no user direction exists.

Section 12.3 -- Fiduciary Authority Under Arizona Law

  • Personal Representative (A.R.S. § 14-13107, § 14-13108): May request disclosure of digital assets of a deceased user. For electronic communication content, the personal representative must provide a written request, certified death certificate, certified letters testamentary or letters of administration, and (unless the user consented) a court order.
  • Agent Under Power of Attorney (A.R.S. § 14-13109, § 14-13110): May request disclosure if the power of attorney specifically grants authority over digital assets.
  • Trustee (A.R.S. § 14-13111 through § 14-13113): Authority depends on whether the trustee is the original user of the account.
  • Conservator (A.R.S. § 14-13114): May request disclosure by providing required court documentation.

Section 12.4 -- Community Property Considerations

Arizona is a community property state. Digital assets acquired during marriage with community funds or effort may constitute community property. This includes but is not limited to:

  • Cryptocurrency purchased with community funds
  • Revenue-generating websites or online businesses developed during marriage
  • Digital media libraries purchased with community funds
  • Loyalty points and rewards earned during marriage

The surviving spouse should consult with an attorney regarding their community property rights in digital assets.

Section 12.5 -- Custodian Compliance (A.R.S. § 14-13106)

A custodian may charge a reasonable administrative fee for compliance with a fiduciary's request. The custodian may require the fiduciary to provide additional documentation as specified under A.R.S. § 14-13106, including a certified copy of the trust instrument or power of attorney, an affidavit stating the relevant provisions are in effect, and a court order if required.
