NEW MEXICO DIGITAL ASSET INVENTORY
Pursuant to the Revised Uniform Fiduciary Access to Digital Assets Act
NMSA 1978, Chapter 46, Article 13 (Sections 46-13-1 through 46-13-18)
LEGAL FRAMEWORK UNDER NEW MEXICO LAW
New Mexico adopted the Revised Uniform Fiduciary Access to Digital Assets Act ("RUFADAA"), effective January 1, 2018, through Laws 2017, Chapter 72. This law governs fiduciary access to digital assets and provides a legal framework for managing digital property after death or incapacity.
Priority of User Direction (Three-Tier Hierarchy)
Under NMSA 1978, Section 46-13-4, user direction controls digital asset disclosure in the following order of priority:

Online Tools (Highest Priority): Direction provided through a custodian's online tool (such as Google Inactive Account Manager or Facebook Legacy Contact) takes precedence over all other instructions.

Estate Planning Documents (Second Priority): In the absence of online tool direction, a user may allow or prohibit disclosure in a will, trust, power of attorney, or other record. This direction overrides contrary provisions in terms-of-service agreements.

Terms of Service (Lowest Priority): If no user direction exists, the custodian's terms of service govern fiduciary access.
Fiduciary Authority Under RUFADAA
Under NMSA 1978, Section 46-13-15, fiduciaries have the following authority:
- A fiduciary with authority over the property of a decedent, protected person, principal, or settlor has the right to access any digital asset in which that person had a right or interest, provided the asset is not held by a custodian or subject to a terms-of-service agreement.
- The legal duties imposed on a fiduciary managing tangible property apply equally to the management of digital assets.
- A fiduciary's authority is subject to applicable terms of service, other applicable law (including copyright law), and is limited by the scope of the fiduciary's duties.
Custodian Disclosure Options
Under NMSA 1978, Section 46-13-6, when disclosing digital assets, a custodian may at its sole discretion:
- Grant a fiduciary full access to the user's account;
- Grant partial access sufficient to perform the tasks with which the fiduciary is charged; or
- Provide a copy of any digital asset the user could have accessed if alive and with full capacity.
