JURISDICTION AND VENUE

  1. This Court has subject matter jurisdiction over this action as it involves claims for damages arising from personal injuries.

COUNT I — NEGLIGENCE

a. Failing to implement and enforce adequate safety measures;
b. Failing to provide proper fall protection and safety equipment;
c. Failing to inspect and maintain the worksite;
d. Failing to warn of known hazards;
e. Failing to supervise construction work in a safe manner;

COUNT II — PREMISES LIABILITY

  3. Defendant Property Owner knew or should have known of the dangerous conditions and failed to correct, remediate, or warn.

COUNT III — OSHA VIOLATIONS AS EVIDENCE OF NEGLIGENCE

  1. Plaintiff re-alleges and incorporates by reference all preceding paragraphs.

  2. At all relevant times, Defendants were required to comply with applicable OSHA standards, including:

a. 29 CFR § 1926.451 (Scaffolding);
b. 29 CFR § 1926.501 (Fall Protection);
c. 29 CFR § 1926.502 (Fall Protection Systems);
d. 29 CFR § 1926.20 (General Safety and Health Provisions);
e. [ADDITIONAL APPLICABLE OSHA STANDARDS].

  1. Defendants violated the above-referenced OSHA standards, which constitutes evidence of negligence.
  1. As a direct and proximate result of Defendants' violations, Plaintiff suffered severe injuries and damages.

COUNT IV — THIRD-PARTY LIABILITY

  2. Pursuant to Ind. Code § 22-3-2-13, while workers' compensation provides the exclusive remedy against an employer under Ind. Code § 22-3-2-6, Plaintiff retains the right to pursue third-party tortfeasors.

d. Disability: Permanent disability and/or disfigurement;

STATE-SPECIFIC NOTES — INDIANA

Modified Comparative Fault (51% Bar): Ind. Code § 34-51-2-6 bars recovery if the plaintiff's fault exceeds that of all defendants combined.

Workers' Compensation Exclusivity: Ind. Code § 22-3-2-6 provides the exclusive remedy against employers. Third-party actions under Ind. Code § 22-3-2-13. Employers/insurers may hold liens on recoveries.

Statute of Limitations: Two (2) years. Ind. Code § 34-11-2-4.
