10. MARYLAND-SPECIFIC NOTES

  • Income Shares Model: Maryland uses the Income Shares Model under Fam. Law § 12-202, considering both parents' adjusted actual incomes.
  • Multifamily Adjustment (2025): Effective October 1, 2025, HB 275 introduced a multifamily adjustment reducing a parent's adjusted actual income by 75% of the basic obligation for additional children in the household for more than 92 overnights per year. Documentation is required.
  • Shared Physical Custody: When each parent has the child for 128 or more overnights per year (35%), the shared physical custody formula applies under § 12-204(a).
  • Above-Guidelines Income: For combined adjusted income exceeding $15,000/month, the court has discretion in setting support above the schedule amount.
  • Voluntary Impoverishment: Courts may impute income if a parent is voluntarily impoverished (§ 12-201(b)(2)).
  • Modification: Either party may seek modification upon a material change in circumstances.
