Transfer and documents

For the total sale price stated above, Seller sells and delivers the identified vessel and included components to Buyer on [__/__/____] at [LOCATION]. Seller identifies these security interests or liens, if any: [NONE / CREDITOR, ADDRESS, AMOUNT, RELEASE PLAN].

Title or prior registration delivered: [FLORIDA TITLE / OUT-OF-STATE TITLE / ELECTRONIC TRANSFER RECORD / PRIOR REGISTRATION FROM A NON-TITLE STATE / OTHER: __________].

Other documents delivered, including lien releases: [________________________________].

For a vessel covered by a written certificate of title, Seller will promptly sign and deliver that certificate as Fla. Stat. § 328.22(1)(a) requires. For an electronic certificate, Seller will sign and deliver a record evidencing the transfer under § 328.22(1)(b). This bill alone does not complete those steps. For a used vessel from a state that does not require title, FLHSMV instructs the applicant to supply the prior registration and a bill of sale from the current registrant.

The parties state that the component descriptions and prices above reflect their actual transaction. Under Fla. Stat. § 328.01(9)(b), an itemized bill of sale has a specific role in a nonexempt title transfer between individuals; the tax collector determines the applicable tax from the completed transfer documents.

Legal authority

  • Fla. Stat. § 328.01(4)(b)3. (bill of sale as possible ownership record when no title is available)
  • Fla. Stat. § 328.01(9)(b) (itemized bill of sale for an individual-to-individual vessel-rig transfer)
  • Fla. Stat. § 328.22(1), (3) (transfer of a titled vessel)

A contract is a written record of what two or more parties agreed to and what happens if someone does not follow through. Clear language, defined terms, and clean signature blocks keep disputes small and enforceable. The most common mistakes in contracts come from vague promises, missing details about timing or payment, and skipping standard protective clauses like governing law and dispute resolution.
