STATEMENT OF SCOPE AND STANDARD OF REVIEW

Issue 1: [________________________________]

Scope: Plenary (the entire record is reviewable).
Standard: De novo review applies to questions of law. (Commonwealth v. Widmer, 744 A.2d 745, 751 (Pa. 2000).)

Issue 2: [________________________________]

Standard: Abuse of discretion applies to discretionary rulings, including evidentiary rulings and sentencing. (Commonwealth v. Widmer, 744 A.2d 745, 753 (Pa. 2000).)

Issue 3: [________________________________]

Standard: Sufficiency of the evidence — viewing the evidence and all reasonable inferences therefrom in the light most favorable to the Commonwealth, the court must determine whether the trier of fact could have found every element of the crime beyond a reasonable doubt. (Commonwealth v. Hawk, 709 A.2d 373, 376 (Pa. 1998).)

Standard: Weight of the evidence — the court must determine whether the verdict was so contrary to the evidence as to shock one's sense of justice. (Commonwealth v. Widmer, 744 A.2d 745, 751-52 (Pa. 2000).)
