5. IDAHO PRACTICE NOTES
- Idaho AG enforcement scope. The Consumer Protection Division investigates and prosecutes violations of the Idaho Consumer Protection Act, the Idaho Charitable Solicitation Act, and other Title 48 statutes. The Division does not represent individual consumers and does not, as a matter of right, recover restitution for them, but its enforcement actions in the public interest under Idaho Code § 48-606 frequently include consumer redress.
- Civil penalties. Idaho Code § 48-606(5) authorizes civil penalties of up to $5,000 per violation in actions brought by the AG. Idaho Code § 48-1505(3) provides enhanced civil relief for violations against elderly (60+) or vulnerable adults — $15,000 per violation or treble actual damages, whichever is greater.
- Public records caveat. Idaho complaints are public records under the Idaho Public Records Act (Idaho Code § 74-101 et seq.). Redact all Social Security numbers, dates of birth, financial account numbers, medical records, and other sensitive information before filing. Email submissions are NOT accepted by the AG; mail or use the online portal.
- Voluntary dispute resolution. The AG's process is voluntary: complaints are forwarded to the business for response. Resolution typically takes several weeks to several months. The AG cannot compel a private settlement.
- Preservation of private rights. Filing an AG complaint does not toll the statute of limitations on private claims. FDCPA: 1 year. ICPA: 2 years (Idaho Code § 48-619). FCRA: 2 years from discovery / 5 years from violation. File a private suit on the calendar regardless of administrative status.
- CFPB authority. The CFPB regulates debt collectors, CRAs, mortgage servicers, payday lenders, student-loan servicers, and most consumer-financial institutions. CFPA Sections 1031/1036 prohibit unfair, deceptive, or abusive acts or practices (UDAAPs).
- Interaction with private litigation. Consumer complaint narratives published in the CFPB database may be admissible to show pattern and practice. Mark sensitive narratives carefully.
- Cross-referrals. The Idaho AG routinely refers matters to the Idaho Department of Finance (collection agencies, mortgage, escrow), the Department of Insurance, the Idaho Real Estate Commission, the FTC, and the CFPB.
- Class actions. The ICPA permits class actions under Idaho R. Civ. P. 23. Pattern-and-practice evidence assembled through AG / CFPB complaint records is often the foundation for class certification.
- Anti-retaliation. While Idaho lacks an explicit anti-retaliation statute for consumer complainants comparable to Colorado's C.R.S. § 6-1-104.5, retaliatory conduct may itself constitute an unfair practice under Idaho Code § 48-603 and may be actionable as tortious interference or intentional infliction of emotional distress.
