I am submitting the enclosed consumer complaint pursuant to the Arizona Consumer Fraud Act, A.R.S. § 44-1521 et seq., and request that the Office investigate the conduct described below. I believe the Respondent has engaged in deceptive or unfair acts or practices in connection with the sale or advertisement of merchandise or services in violation of A.R.S. § 44-1522 and applicable federal consumer protection laws.
I have attempted to resolve this matter directly with the Respondent. Despite my efforts, the matter remains unresolved. I am also filing a parallel complaint with the Consumer Financial Protection Bureau and reserve all civil remedies under A.R.S. § 44-1522, the Fair Debt Collection Practices Act (15 U.S.C. § 1692 et seq.), the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.), and other applicable law.

9. ARIZONA PRACTICE NOTES
- AG investigative authority. Under A.R.S. § 44-1531, the Attorney General may investigate suspected ACFA violations and issue civil investigative demands under § 44-1532. Most consumer complaints are handled through informal mediation by the Consumer Information and Complaints Unit; only a small subset proceed to formal enforcement.
- No private right of action created by complaint. Filing an AG or CFPB complaint does not create or extend a civil cause of action. The ACFA one-year limitations period (A.R.S. § 12-541(5)) and the FDCPA one-year period (15 U.S.C. § 1692k(d)) continue to run. Preserve the private claim by filing suit in parallel if necessary.
- CFPB complaint flow. Once submitted, the CFPB forwards the complaint to the responding company. The company must respond within 15 days and is expected to provide a final response within 60 days. The consumer may rate the company's response and (with consent) the narrative may appear in the public Consumer Complaint Database.
- Redaction. Both the AG and the CFPB share the complaint with the respondent. Redact full SSN, dates of birth, full account numbers, and minor children's information.
- Senior victims. If the consumer is 65+ or a vulnerable adult, additional remedies are available under A.R.S. § 46-455 (vulnerable adult abuse) and § 13-1802 (theft from a vulnerable adult). Note this status on the AG complaint to expedite review.
- Active litigation. The AG generally will not investigate matters pending in court. Disclose any pending litigation in the cover letter.
- Other regulators. For specific industries, parallel filings with DIFI (banking, lending, mortgage, debt collection), the Department of Insurance (insurance), the Registrar of Contractors (construction), the Department of Real Estate, the State Bar (attorney conduct), or the Medical Board may be more effective than an AG complaint alone.
