Requirements one by one

Solemnizers and society route

KRS 402.050(1) lists ministers or priests in regular communion with a religious society; specified active or retired judges and justices, county judges or executives, and authorized justices of the peace or fiscal court commissioners. A religious society without an officiating minister or priest may also solemnize at its usual place of worship by the parties' consent before the assembled society, if either party belongs to it.

License and attendance

A license is required before solemnization (KRS 402.080) and remains valid 30 days, including its issue date (KRS 402.105). At least two persons besides the parties and the person solemnizing must attend every marriage (KRS 402.050(2)). The society route expressly requires consent before the congregation; the quoted general provision does not prescribe a separate formula of words for other ceremonies.

Certificate and return

The certificate form records the names of two witnesses and the name, title, and dated signature of the person performing the ceremony (KRS 402.100(2)). It also supplies a separate ceremonial certificate for the parties under KRS 402.100(3). The solemnizer, or the clerk of a qualifying religious society, returns the license with a signed marriage certificate to the issuing county clerk within one month, giving the date, place, and names of at least two people present (KRS 402.220). The clerk files it and keeps the marriage register (KRS 402.230).

What trips people up

KRS 402.100(2)(b) says the society clerk need not be present when the society's witnesses are present. The statute asks for the witnesses' names on the certificate, while the dated signature field is the ceremony performer's. The form also has the county clerk's later recording statement; it is distinct from the performer or society clerk's return duty (KRS 402.100(2)(d); KRS 402.220).

Does the completed license go to the county where the ceremony happened? KRS 402.220 sends it to the county clerk who issued the license.
