Requirements one by one
Officiant, declaration and witnesses
Section 23-2504(b) lists the qualified religious authorities and current or retired judges who may officiate. In the ordinary route, the couple must make mutual declarations that they take each other as husband and wife before the officiant and at least two competent witnesses over 18, other than the officiant (§ 23-2504(a)). The statute states the substance of the declaration, not a longer script.
License timing
The license must issue before solemnization (§ 23-2504(a)); § 23-2509 directs the applicant to deliver its duplicate to the performer. A district court clerk or judge normally waits until the third calendar day after application to issue it; a district judge may order earlier issuance for emergency or extraordinary circumstances (§ 23-2505(b)). An unused license expires six months after issuance (§ 23-2505(f)).
Religious routes
The parties may marry without an officiant through mutual declarations under the customs of a religious society, denomination or sect to which either belongs (§ 23-2504(c)). The law also recognizes Friends' customary rites and allows a local Baha'i spiritual assembly or its representative members to perform and witness a ceremony and certify its facts and date on the license (§ 23-2516(a)–(b)).
Certificate and return
The performer endorses a certificate of marriage on the license, gives its duplicate to the couple, and returns the license to the issuing district court judge or clerk within 10 days (§ 23-2511). The Judicial Branch says the court accepts a completed license sent by either the couple or the officiant. The clerk later sends license information to the state vital statistics system by the third day of the following month (§ 23-2511).
What trips people up
The Kansas Judicial Branch expressly says the Office of Vital Statistics accepts a proxy marriage when the officiant and one party are in Kansas and two witnesses can view the ceremony. Its FAQ also accepts electronic signatures from the officiant and witnesses. Section 23-2504(a) supplies the ordinary declaration and witness rule; the FAQ supplies these implementation details.
Common questions
Can the parties conduct their own ceremony? Yes, if their mutual declarations follow the customs, rules and regulations of a religious society, denomination or sect to which either belongs (§ 23-2504(c)).
Must the couple wait three days after getting the license? The three-day period controls ordinary issuance after application. Once the license issues, § 23-2504(a) permits solemnization; § 23-2505(f) gives an unused license six months.
