Alaska's narrow uniform-and-equipment rule
The Alaska Legislature's labor title and the Department of Labor and Workforce Development's current wage-and-hour compilation state no general requirement that an ordinary private employer reimburse every necessary or reasonable employee business expense. Current 8 AAC 15.165 instead addresses specified uniform and equipment purchases.
An employer may not require an employee to buy a uniform or equipment required by a federal, state, or local safety or health code. The same prohibition applies when the nature of the employer's business requires the item and it either is distinctive and associated with the employer's products or services, or cannot be worn or used during the employee's normal social activities.
The branded-item branch has an exception when the employer customarily sells the uniform or equipment to the public. The regulation does not turn this specific purchase rule into a general mileage, travel, phone, home-office, ordinary clothing, supply, or employee-loss reimbursement mandate.
Section 8 AAC 15.165 states no employee request deadline, receipt form, itemization requirement, reimbursement cap, repayment clock, payment method, interest rule, private damages formula, attorney-fee provision, or limitations period. Alaska DOLWD's Wage and Hour office publishes and administers the rule.
What trips people up
The rule prohibits requiring the employee to make the covered purchase. It does not state a general after-the-fact reimbursement procedure or a number of days for repaying an employee who already paid.
An item required by the business is not automatically covered. Under the second branch of 8 AAC 15.165, it must also meet the distinctive/associated test or be unusable during normal social activities.
