What is CH-100?
California Judicial Council mandatory-use form to request a Civil Harassment Restraining Order (CHRO) under Code of Civil Procedure section 527.6. Use CH-100 when the person you need protection from is NOT a current or former intimate partner, close family member, or someone you live with (those cases use DV-100 under the Domestic Violence Prevention Act). Civil harassment covers neighbors, coworkers, classmates, distant family, ex-friends, and strangers, where the conduct is unlawful violence, a credible threat of violence, or a course of conduct that seriously alarms, annoys, or harasses you and causes substantial emotional distress. CH-100 travels with CLETS-001 (Confidential CLETS Information) and, if you are seeking a temporary restraining order, CH-110 (Temporary Restraining Order) for the judge's signature.
What happens if you miss the deadline: Missing the 5-day personal-service deadline usually means the court continues the hearing rather than dismissing the case. Failing to appear at the noticed hearing dismisses the case; you can refile.
How to file
- Filing fee
- Filing fee is $0 if the petition is based on unlawful violence, a credible threat of violence, or stalking (Government Code section 6103.4; CCP 527.6(s)). Otherwise, the fee is roughly $435 to $465; file FW-001 fee waiver if you cannot afford it. Free sheriff/marshal service on the same violence/threat/stalking basis.
- Filing method
- in-person, mail, efile (county-specific)
- Filing deadline
- No filing deadline. After filing, the court rules on a TRO request the same day or next court day (CCP 527.6(d)). The hearing on the permanent order must be set within 21 days of filing, or 25 days if the court grants good cause to extend (CCP 527.6(g)). Personal service must happen at least 5 days before the hearing, unless the court shortens the time on item 12.
- How to serve
- Personal service on the restrained person at least 5 days before the hearing (CCP 527.6(g) and 527.6(m)). The sheriff or marshal serves for free if the petition rests on violence, credible threat of violence, or stalking. Use CH-200 (Proof of Personal Service) to file the proof. Service cannot be by mail.
- Wet signature
- Yes, sign in pen after printing.
- Notarization
- No
- Original and copies
- Original plus two copies to the clerk: one for the court, one for the petitioner, one for the sheriff/marshal to use for service. Bring extras if you have multiple protected persons or attachments.
Don't memorize the rules. Ezel walks you through CH-100 field by field, flags what the AI review treats as a blocker, and renders a court-ready PDF.
