2. PURPOSE OF THIS LETTER

5. LEGAL BASIS FOR THIS DEMAND

5.1 Utah Payment of Wages Act (Utah Code Ann. Section 34-28-1 et seq.)

The Utah Payment of Wages Act governs the payment of wages to employees in the State of Utah. It establishes requirements for the timing, manner, and frequency of wage payments, and imposes penalties on employers who fail to comply.

5.2 Wage Payment Intervals (Section 34-28-3)

Utah law requires employers to pay wages at regular intervals not to exceed semimonthly. Each employer shall designate paydays in advance. 7. CONSEQUENCES OF NON-PAYMENT

7.1 Administrative Complaint — Utah Labor Commission

The Employee may file a Wage Claim Assignment Form with the Utah Antidiscrimination and Labor Division (UALD) of the Utah Labor Commission. The UALD processes, investigates, mediates, and adjudicates wage claims between $50 and $10,000. The Division has authority to issue orders for payment and assess penalties against the employer, part of which will be paid to the employee.

IMPORTANT: For claims of $10,000 or less, Utah Code Section 34-28-19(2)(a) requires the employee to exhaust administrative remedies through the Labor Commission before filing a civil action in court.

7.2 Civil Action
