PART 1 — PRE-FILING ELIGIBILITY & GROUNDS CHECKLIST

☐ Residency / domicile (Mont. Code Ann. § 40-4-104(1)(a)): At the time the action is commenced, one of the parties was domiciled in Montana, or stationed in Montana as a member of the armed services, and that domicile or military presence was maintained for 90 days preceding the filing.
☐ Child-custody jurisdiction: If parenting orders are requested, analyze the UCCJEA under Mont. Code Ann. § 40-7-201. PART 8 — STEP-BY-STEP FILING PROCEDURE

  1. Confirm jurisdiction and venue — 90 days domicile/military presence for one spouse under § 40-4-104; county venue under § 25-2-118(3); and, if parenting orders are requested, UCCJEA jurisdiction under § 40-7-201.
