ARKANSAS UNCONTESTED DIVORCE COMPLAINT + DECREE FILING PACKET

CRITICAL ARKANSAS NOTICE — FAULT GROUNDS STILL REQUIRED

Arkansas is one of only THREE states in the U.S. that still requires FAULT GROUNDS for divorce in the great majority of cases (along with Mississippi and South Dakota, in part). Ark. Code Ann. § 9-12-301.

The only "no-fault-like" ground is 18 continuous months living separate and apart without cohabitation under § 9-12-301(b)(5) — the longest mandatory separation period in the United States.

Most uncontested filings rely on "general indignities" under § 9-12-301(b)(3)(C), requiring specific examples of habitual mistreatment beyond mere incompatibility.

Corroboration of grounds AND residency by a non-party witness is required even in uncontested cases. § 9-12-306.

No remarriage to anyone for 30 days after entry of decree absent court permission. § 9-12-322.

About This Template

Family law covers the paperwork that shapes divorce, custody, child support, adoption, guardianship, and other family matters. These filings are emotional and high-stakes, and they also have to meet strict procedural rules for service, financial disclosure, and parenting plans. Clean, accurate paperwork keeps the focus on getting a workable outcome for the family instead of getting derailed by technical problems that delay hearings or force amended filings.

Important Notice
