ARTICLE II: CONVEYANCE

Section 2.1 Granting Clause

ARTICLE III: LIMITED WARRANTY COVENANTS

Section 3.1 Special Warranty

Pursuant to A.R.S. § 33-435, by the use of the words "grant" and "convey" in this deed, the following covenants are implied on the part of the Grantor, and the Grantor hereby specially warrants:

(a) Covenant Against Prior Conveyances: That previous to the time of execution of this conveyance, the Grantor has not conveyed the same estate or any right, title, or interest therein to any person other than the Grantee; and

(b) Covenant Against Encumbrances: That at the time of execution of this conveyance, the estate is free from encumbrances done, made, or suffered by the Grantor, or any person claiming under the Grantor.

Section 3.2 Limitation of Warranty

NOTICE: This is a SPECIAL WARRANTY DEED. The Grantor warrants and will defend the title only against the lawful claims and demands of all persons claiming by, through, or under the Grantor, but not otherwise. This deed does NOT contain full warranty covenants and does NOT warrant against defects in title arising prior to the Grantor's period of ownership.

Section 3.3 Statutory Effect

This conveyance is made pursuant to and in accordance with the laws of the State of Arizona, including but not limited to:

(b) All applicable zoning ordinances, building codes, and governmental regulations;

(c) All covenants, conditions, restrictions, reservations, rights, rights-of-way, and easements of record;

(d) All matters that would be disclosed by an accurate survey and inspection of the property;

(e) All matters that would be disclosed by inquiry of parties in possession;
