Iowa's Preference for Joint Legal Custody
Iowa Code § 598.41(1)(a) directs the court to order a custody arrangement that provides the child the opportunity for maximum continuing physical and emotional contact with both parents and encourages parents to share the rights and responsibilities of raising the child. If either parent requests joint custody, the court must consider granting it. Iowa Code § 598.41(2).
Sole legal custody is typically awarded only when the court finds that joint legal custody is not in the child's best interest, such as when:
- A history of domestic abuse exists (Iowa Code § 598.41(1)(b) — rebuttable presumption against joint custody)
- The parents cannot communicate regarding the child's needs (Iowa Code § 598.41(3)(c))
- One parent is unfit, absent, or poses a safety risk to the child (Iowa Code § 598.41(3)(i))
- One parent has allowed a sex offender unsupervised access to the child (Iowa Code § 598.41(3)(k))
Iowa's "Physical Care" Terminology
Iowa uses "physical care" — not "physical custody." Under Iowa Code § 598.1, physical care means the right and responsibility to maintain a home for the child and provide routine daily care. This Agreement uses Iowa's statutory terminology.

IV. SOLE LEGAL CUSTODY PROVISIONS
A. Custodial Parent's Rights and Responsibilities
Under Iowa Code § 598.41(5)(a), the Custodial Parent has sole authority over all major decisions regarding the children, including:
- Education — School enrollment and transfers, special education services, IEPs, Section 504 plans, tutoring, gifted programs, and college planning
- Medical Care — Selection of healthcare providers, non-emergency medical and dental procedures, medications, mental health treatment, and elective procedures
- Religious Instruction — Religious education, training, and observances
- Extracurricular Activities — Enrollment in sports, music, arts, clubs, and other organized activities
- Legal Status — Legal proceedings, passport applications, name changes
- Residence — Determination of the children's primary residence (subject to relocation provisions in Section VII)

B. Noncustodial Parent's Rights
Notwithstanding sole legal custody, the Noncustodial Parent retains the following rights under Iowa law:
- Access to records: The Noncustodial Parent has the right to obtain information from schools, medical providers, and other institutions directly, unless restricted by court order.
- Information: The Custodial Parent shall provide the Noncustodial Parent with copies of report cards, significant medical information, and notice of school events within a reasonable time.
- Emergency notification: The Custodial Parent shall notify the Noncustodial Parent within 24 hours of any emergency, serious illness, injury, or hospitalization.
- Parenting time: As set forth in Section V below.
V. PHYSICAL CARE AND PARENTING TIME
A. Primary Physical Care
The Custodial Parent shall have primary physical care of the children. The children shall reside primarily at the Custodial Parent's address set forth in Section I.

VI. COMMUNICATION

VII. RELOCATION
A. Iowa Code § 598.21D — 150-Mile Rule
If the Custodial Parent intends to relocate the children's residence 150 miles or more from the children's residence at the time custody was awarded, the Custodial Parent shall provide the Noncustodial Parent written notice at least 60 days before the proposed move.
B. Notice Requirements
The notice shall include:
- New address and telephone number
- Date of proposed move
- Reason for relocation
- Proposed revised parenting time schedule
- Children's proposed new school
C. Court Review
If the Noncustodial Parent objects, the Court shall modify the order to preserve, as nearly as possible, the existing relationship between the children and the Noncustodial Parent. Modifications may include extended summer and school-break visitation, scheduled telephone/video contact, and allocation of transportation costs.
D. Moves Within Iowa (Under 150 Miles)
The Custodial Parent may relocate within Iowa with 30 days' written notice to the Noncustodial Parent. The parties shall cooperate to adjust the parenting time schedule.
E. Domestic Abuse Victim Exception
Under Iowa Code § 598.41(1)(c), if the Custodial Parent is a victim of domestic abuse and relocates based on fear of or actual domestic abuse, the court shall not consider such relocation as a factor against the Custodial Parent.
VIII. CONDUCT AND RESTRICTIONS
A. Non-Disparagement
Neither parent shall make negative, derogatory, or disparaging remarks about the other parent in the children's presence or hearing.
B. Non-Interference
The Noncustodial Parent shall not interfere with the Custodial Parent's authority, the children's school attendance, medical care, or daily routine.
C. Timely Return
The Noncustodial Parent shall return the children at the scheduled time and location. Failure to return children without reasonable cause is a material breach and may constitute grounds for contempt.
D. Substance Use
☐ Neither parent shall consume alcohol to impairment or use illegal substances during parenting time or within 12 hours before parenting time.

If supervised parenting time is ordered, the Noncustodial Parent shall comply with all conditions, including paying any supervision fees, following the supervisor's behavioral guidelines, and not attempting to see the children outside scheduled supervised visits.
IX. DISPUTE RESOLUTION
A. Mediation
Before filing any motion with the Court (except in emergencies or cases involving domestic abuse), the parties shall attempt mediation with a qualified family mediator. Iowa judicial districts maintain approved mediator lists.
Exception: Mediation is not required when a protective order under Iowa Code Chapter 236 is in effect or when domestic abuse is alleged.
B. Court Jurisdiction

The moving party must prove: (1) a substantial change in circumstances that is more or less permanent and relates to the children's welfare; and (2) the ability to minister more effectively to the children's needs.
