Nebraska Lease, Timing, and Electronic-Delivery Gate

Nebraska Revised Statute § 76-1437 permits termination of a week-to-week tenancy by written notice at least 7 days before the termination date and termination of a month-to-month tenancy by written notice at least 30 days before the periodic rental date specified in the notice. It is a termination statute, not standalone rent-increase authority. Identify the lawful lease-modification or renewal basis and have counsel confirm the controlling period.

If electronic delivery is used under § 76-1413 as amended by 2025 LB 185, verify the tenant's affirmative consent, required disclosures, ability to withdraw consent, receipt requirements, and any required nonelectronic fallback. Do not assume ordinary email alone is sufficient.

Legal authority

  • 42 U.S.C. § 3604(b)
  • Neb. Rev. Stat. §§ 76-1413, 76-1437

Landlord-tenant paperwork governs who can stay in a property, on what terms, and what happens when something goes wrong. Leases, notices to quit, security deposit demands, and habitability complaints all have state and often city-specific requirements for timing, content, and service. Getting the paperwork right is what makes an eviction actually succeed or a security deposit actually come back, because judges regularly dismiss cases over small procedural mistakes.
