RECITALS

1.2 Definitions

"Session" means a scheduled tutoring appointment of the duration specified herein.

"Academic Materials" means textbooks, workbooks, practice tests, worksheets, and other educational resources used during Sessions.

"Tutoring Location" means the physical or virtual location where Sessions are conducted.

SECTION 4: PARENT/GUARDIAN OBLIGATIONS

4.2 Parent Responsibilities

6.2 Cancellation by Parent/Student

6.3 Cancellation by Tutor

6.4 Inclement Weather

  • Sessions may be canceled due to severe weather conditions
  • Weather cancellations will be rescheduled without penalty

6.5 Illness Policy

  • Do not attend Sessions if Student or Tutor is ill

8.3 Mandatory Reporting

SECTION 9: LIABILITY AND ASSUMPTION OF RISK

9.1 Limitation of Liability

Parent acknowledges and agrees that:

☐ Tutor does not guarantee specific academic outcomes, grade improvements, or test scores
☐ Academic success depends on multiple factors including Student effort, attendance, and study habits
☐ Tutor is not responsible for Student's final grades or academic standing
☐ Tutor's maximum liability shall not exceed the total fees paid under this Agreement

9.2 Assumption of Risk

Parent acknowledges that:

☐ Tutoring involves inherent risks including but not limited to: exposure to illness, travel to/from Sessions, and typical risks of educational activities
☐ Parent has voluntarily chosen to engage tutoring services with full knowledge of these risks
☐ Parent accepts responsibility for Student's conduct during Sessions

9.3 Indemnification

Parent agrees to indemnify and hold harmless Tutor from any claims, damages, or expenses arising from:

☐ Student's intentional misconduct or negligence
☐ Parent's breach of this Agreement
☐ Inaccurate information provided by Parent about Student
☐ Third-party claims related to Student's conduct

9.4 Insurance

SECTION 10: INTELLECTUAL PROPERTY

10.1 Tutor Materials

  • Custom materials, worksheets, and lesson plans created by Tutor remain Tutor's intellectual property

  • Materials may not be reproduced, distributed, or used commercially without Tutor's written consent

10.2 Student Work

  • Student retains ownership of original work created during Sessions
  • Tutor may retain samples of Student work for portfolio purposes with Parent consent

SECTION 11: TERM AND TERMINATION

11.1 Term

This Agreement shall commence on [START DATE] and continue until:

11.2 Termination

Termination by Either Party:

11.3 Effect of Termination

Upon termination:

SECTION 12: DISPUTE RESOLUTION

12.1 Informal Resolution

The parties agree to attempt to resolve any disputes through good-faith discussion before pursuing formal remedies.

12.2 Mediation

If informal resolution fails, disputes shall be submitted to mediation before a mutually agreed mediator, with costs shared equally.

12.3 Governing Law

This Agreement shall be governed by the laws of [STATE], without regard to conflicts of law principles.


SECTION 13: GENERAL PROVISIONS

13.1 Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings.

13.2 Amendments
