PERSONAL PROPERTY MEMORANDUM

State of Connecticut

IMPORTANT LEGAL NOTICE

Connecticut is not a UPC § 2-513 state. Connecticut does not have a specific
statute authorizing a separate writing or memorandum for the disposition of tangible
personal property that may be created or modified after will execution. This
memorandum has limited legal enforceability in Connecticut unless properly
incorporated by reference into a will that was executed after this writing was
prepared.

Recommended alternatives in Connecticut:

  • Specific bequests in the will for important items of tangible personal property
  • Codicil to add or change tangible property gifts after will execution
  • Revocable living trust with a personal property schedule
  • Letter of intent (non-binding but helpful guidance for the executor)
  • This memorandum as an incorporation-by-reference document (with limitations)

3. LEGAL AUTHORITY AND LIMITATIONS

Connecticut has not adopted UPC § 2-513 or any equivalent statute authorizing a standalone personal property memorandum. The doctrine of incorporation by reference may permit this writing to be given legal effect, subject to the following limitations:

6. GENERAL PROVISIONS

About This Template

Estate planning documents decide what happens to your property, your children, and your medical care when you cannot make those decisions yourself. Wills, trusts, powers of attorney, and health care directives each serve different purposes and each have to meet state law requirements for signing, witnessing, and notarization. A document that looks fine on the page but was not executed correctly can be rejected in probate, which is exactly when it is too late to fix.

Important Notice
